In Reference 1, NextEra Energy Seabrook, LLC (NextEra) requested pursuant to 10 CFR 50.90 and 10 CFR 50.91(a)(5), an emergency amendment to Renewed Facility Operating License NPF-86 for Seabrook Nuclear Plant Unit 1 (Seabrook). The proposed change would modify on a one-time basis, the Allowed Outage Times (AOTs) associated with Seabrook Technical Specifications (TS) 3/4.8.1, A.C. Sources -

Operating for an inoperable offsite power source. In Reference 2, NextEra requested approval for enforcement discretion from TS 3/4.8.1.1 in accordance with NRC Enforcement Manual, Appendix F, "Notices of Enforcement Discretion." On March 3, 2024, the NRC granted verbal approval of NextEras enforcement discretion request. In Reference 3, NextEra provided supplemental information regarding the Reference 1 application following a clarification call with the Nuclear Regulatory Commission (NRC) staff.

In this letter, NextEra provides additional clarifying information concerning the no significant hazards evaluation (NSHE) accompanying the Reference 1 application. Specifically, in the response to question #3 of the NSHE on page 13 of the enclosure to Reference 1, the statement within the parentheses regarding only one emergency power bus is in error and should be removed, as indicated by the struck-out text below.

(3) Does the proposed amendment involve a significant reduction in a margin of safety?

Response: No The proposed amendment increasing the AOT for TS 3/4.8.1 Action a.3 for replacement of the 3B Reserve Auxiliary Transformer reduces the margin of safety for accident mitigation by removing redundancy in the offsite power source (i.e., only one emergency power bus may be supplied from offsite sources during this maintenance window). As stated previously, the reduction in margin is not significant due to compensatory measures that will be in place during the extended completion time.
