dated October 19, 2004 In accordance with 10 CFR 50.55a, "Codes and standards," paragraph (g)(4)(iv), and the guidance provided in References 1 and 2, Northern States Power Company, a Minnesota corporation, doing business as Xcel Energy (hereafter "NSPM"), requests NRC approval to use a specific provision of a later edition of the American Society of Mechanical Engineers (ASME)

Boiler and Pressure Vessel (BPV) Code,Section XI, for the Monticello Class MC [Metal Containment] Component lnservice Inspection (GISI) program. Specifically, NSPM requests approval to use the 2019 Edition of the ASME BPV Section XI code for the Third Interval GISI program starting June 1, 2023 for the duration of the 3rd GISI Interval, which is currently scheduled to end on September 8, 2029.

NSPM requests approval of this request by June 1, 2023 based on the start of the subsequent lnservice Inspection (ISi) interval and maintaining alignment in the use of the 2019 ASME Section XI code for Repair/Replacement (R/R), post-R/R pressure testing (PT), and Non destructive Examination (NOE) activities at Monticello.

Summary of Commitments This letter makes no new commitments and no revisions to existing commitments.

L-MT-23-004 ENCLOSURE REQUEST IN ACCORDANCE WITH 10 CFR 50.55a(g)(4)(iv)

FOR USE OF A PROVISION OF A LATER EDITION OF THE ASME BOILER AND PRESSURE VESSEL CODE, SECTION XI NSPM MONTICELLO 3RD INTERVAL CONTAINMENT INSERVICE INSPECTION PROGRAM (RR-001)

In accordance with 10 CFR 50.55a, "Codes and standards," paragraph (g)(4)(iv) and the guidance provided of Regulatory Issue Summary (RIS) 2004-12 and RIS 2004-16, Northern States Power Company, a Minnesota corporation, doing business as Xcel Energy (hereafter "NSPM"), requests NRC approval to use provisions of a later edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (BPV) Code,Section XI, for the Monticello Nuclear Generating Plant (MNGP).

1. ASME Code Components Affected Class MC (Metal Containment) components in the ASME BPV Section XI Containment lnservice Inspection (CISI) Program at MNGP subject to Repair/Replacement (R/R), post-R/R pressure testing (PT), and non-destructive examination (NOE) activities.

2. Applicable Code Edition and Addenda

The MNGP CISI Program is currently in the 2nd period of the 3rd interval and the 2013 Edition of ASME BPV Section XI is the Code of Record with the exception that R/R activities are performed in accordance with ASME BPV Section XI 2007 Edition with the 2008 Addenda, as authorized by Reference 1. MNGP does not have a concrete containment, and therefore, the MNGP CISI Program only includes rules for MC components under ASME BPV Section XI, Subsection IWE.

The MNGP lnservice Inspection (ISi) Program 6th interval Code of Record will be the 2019 Edition of ASME BPV,Section XI.

3. Proposed Subsequent Code Edition and Addenda (or Portion)

A. Background The ASME BPV Section XI ISi program activities at MNGP is currently being updated for the new 6th interval in accordance with the 10-year update requirements of 10 CFR 50.55a(g)(4)(ii) and will use the 2019 Edition of ASME BPV Section XI as the Code of Record starting on June 1, 2023. The MNGP CISI Plan is not scheduled to be updated until September 9, 2029.

Though the MNGP ISi and CISI programs' intervals start and end dates are not aligned, there are common ASME BPV Section XI activities to both ISi and CISI: the R/R, PT, and NOE programs. If the MNGP R/R, PT, and NOE programs for both ISi and CISI are not aligned to the same edition and addenda of Section XI, then separate program documents with implementing procedures would be required.

Proposed Use of Subsequent Code Edition and Addenda Pursuant to 10 CFR 50.55a(g)(4)(iv) and following the guidance of RIS 2004-12 and RIS 2004-16, NSPM requests, for the MNGP CISI program beginning June 1, 2023 and continuing for the duration of the 3rd CISI interval, to use the 2019 Edition of ASME BPV Section XI for R/R, PT, and NOE activities.

In implementing this proposal for R/R, PT, and NOE activities, MNGP will also comply with all NRC conditions specified in 10 CFR 50.55a that are applicable to the 2019 Edition.

CISI examinations and tests will continue to be selected, planned, and scheduled in accordance with the CISI program present Code of Record as described in Section 2, above.

4. Related Requirements NSPM is requesting permission to use the 2019 Edition of ASME BPV Section XI for the performance of R/R activities, PT, and NOE of items within the scope of the CISI program. In making this request, NSPM will comply with all related requirements in Section XI as described below:

For the third interval CISI Program, NSPM will use the appropriate portions of "Articles" (e.g.,

IWA-1000, IWA-2000, etc.) from each "Subsection" (e.g., IWA, IWB, etc.) of the 2019 Edition that are required for the performance of R/R activities, PT, and NOE. NSPM will also use all "Mandatory Appendices" of the 2019 Edition that are referenced by IWA-2000, IWA-4000, and IWA-5000.

With regard to the performance of IWE examinations and tests, NSPM will continue to select, plan, and schedule these IWE inspection activities as specified in IWA-2500 and IWE-2500 in accordance with CISI program code of record, the ASME BPV Section XI 2013 Edition. To ensure that all related requirements are met, NSPM will also continue to comply with applicable portions of IWA-2000 and all provisions of IWE-1000 and IWE-2000 from the CISI program code of record.

5. Duration of Proposed Request The duration of this request will be from June 1, 2023, and following approval by the NRC staff, until the end of the 3rd CISI interval for MNGP, which is currently scheduled to end on or about September 8, 2029.
