. APPENDIX A NOTICE OF VIOLATION United States Testing Company,_Inc.
Docket No. 030-20952 Hoboken, New Jersey- 07030 License No. 29-02477-09 LAs a result of the inspection conducted from September 25 to October 17, 1985,
.and in'accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violation was identified:
' Condition 17'of License No. 29-02477-09 requires the licensee to possess and use. licensed material in accordance with statements, representations, and
,
-procedures-contained in the letter dated December 1, 1983 with attachments,

_plus other. documents.
The' licensee's-Radiation Safety Program (RSP) was submitted with the December 1, 1983 letter.
In Attachment C of their Operating Procedures, as shown.in'the RSP, it states, under 1.B, " Personnel who have no need to enter a
. restricted' area or who are not adequately monitored and aware of the radiation field must'not be allowed to enter a restricted area.
If unauthorized personnel cannot be prevented from entering the area, the source must be immediately. returned to its shielded position."
Contrary to the above' requirement, on May 29, 1985, four craft workers who were not adequately monitored and aware of the radiation field were allowed to enter a restricted area at the Clinton Power Station during a radiography-operation and the source was not immediately: returned to its shielded position. The restricted area had been established by the licensee for an earlier, similar radiographic operation at the same location.
This is a Severity Level.IV violation (Supplement-VI).
-Pursuant to the. provisions of 10 CFR 2.201, United States Testing Company, Inc.
is hereby equired to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the.
- results achieved; (2) corrective steps which will be taken to avoid further violations; and-(3) the date when full compliance will be achieved. Where-good cause is shown,' consideration will be given to extending this response time.
