Dear Mr. Ippolito:

Reference 1 submitted for NRC approval revised Radiological Effluent Technical Specifications for Cooper Nuclear Station. In this transmittal the District requested that the entire preselt Appendix B Technical Specifications be deleted since the limitations, monitoring and recording requirements for thermal and chemical discharges as well as fish entrapment in the intake structure are also imposed and enforced by regulations of the U.S.

Environmental Protection Agency and the Nebraska Department of Environmental Control, and in accordance with the National Pollutant Discharge Elimination System (NPDES)

Program administered by the Nebraska Department of Environmental Control.

Since this request for deletion of the Appendix B Technical Specifications has not been approved to date, Nebraska Public Power District requests that Specification 2.1.2/3.1.2

" Maximum Discharge Temperature" be expeditiously deleted at this time as indicated on the enclosed revised pages (Enclosure 1).

This deletion is suSgiltted at the request of the I&E Region IV office since the 103 r maximum discharge temperature limit is tased on a river temperature of 85 F and the Missouri River temperature has excegded this value by several degrees during the past week.

The 103 P limit has been exceeded each day during the period, July 9 through July 12, 1980, and is expected to be exceeded during the duration of the present summer hot-spelf.

The present Technical Specifications allow for exceeding the 103 F 8007280 % 2-

Emergency need is an ambiguous term, and there is a potential for Technical Specification violations.

This Technical Specification deletion will not result in adverse tnermal effects to the Missouri River since CNS will still be required to adhere to the NPDES permit whiclg also specifies the daily maximum discharge temperature as 103 F and allows for exceeding this value with written notification of noncompliance. A copy of the CNS NPDES Permit and Section 401 State Certification Letter was provided in Reference 2.

Three applicable pages are enclosed for information (Enclosure 2). Additionally, this change is in keeping with the following recent deletions to the Appendix B Technical Specifications:

Amendment 47 June 21,1978 Deleted biological studies associated with Zooplankton and Phytoplankton Amendment 54 March 9,1979 Deleted the requirement for enermal mixing zone limit and the associated thermal mixing zone Amendment 60 December 7,1979 Terminated the aquatic 2

surveillance study and evaluation program Amendment 63 June 24,1980 Deleted the specification for maximum AT across the condenser Payment for a Class III amendment in the amount of $4,000 was submitted with Reference 1 which included deletion of this Technical Specification; therefore, no additional payment is enclosed for this approval.
