On May 10,

1995, the NRC notified Florida Power and Light Company (FPL) of the initiation of a formal consultation with the National Marine Fisheries Service (NMFS) regarding sea turtles entrapment at the St. Lucie Plant.

The consulation was initiated in accordance with Section 7 of the Endangered Species Act (ESA) and 50 CFR 402, Interagency Cooperation, ESA of 1973, as amended.

The need for a

formal consulation was based on the increasing number of federally protected sea turtles being removed from the St. Lucie Plant intake canal in recent months, as reported in the Annual Environmental Operating Report 1994 Volume I prepared by FPL.

As a result of meetings between the

NRC, NMFS, Florida Department of Environmental Protection (FDEP),

and FPL on April 25,

1995, and October 19,
1995, FPL has prepared the enclosed biological assessment, Assessment of'he I'mpacts oZ the St.

Lucie Nuclear Generating Plant on Sea Turtle Species Found in the Nearshore Waters oZ Florida.

Two copies of the biological assessment are provided for your use.
