Perry Nuclear Power Plant Docket No. 50-440, License No. NPF-58 Core Operating Limits Report for Operating Cycle 16, Revision 23, with Provisions for Proprietary Information By correspondence dated April 13, 2015, FirstEnergy Nuclear Operating Company (FENOC) submitted Revision 22 of the Perry Nuclear Power Plant (PNPP) Core Operating Limits Report for Operating Cycle 16.

The report was submitted to the Nuclear Regulatory Commission (NRC) in accordance with PNPP Technical Specification 5.6.5, "Core Operating Limits Report (COLR)."

By correspondence dated April 28, 2015, Global Nuclear Fuel - Americas, LLC (GNF) informed FENOC this report contained proprietary information and should have been withheld from public disclosure in accordance with 10 CFR 2.390.

On April 28, 2015, FENOC documented this issue in the corrective action program.

During follow-up communications with NRC staff, FENOC staff discussed the report's proprietary nature and requested it be removed from the NRC's publically accessible Agencywide Documents Access and Management System (ADAMS).

Subsequent to the request, NRC staff removed the report from ADAMS.

As a replacement, Revision 23 of the PNPP Core Operating Limits Report for Operating Cycle 16 is provided as Enclosure A.

This report contains proprietary information and should be withheld from public disclosure under 10 CFR 2.390.

Enclosure B provides the nonproprietary version of this report.

There are no technical changes between revision 22 and revision 23.

Enclosure C provides the GNF proprietary information affidavit.

1.0 INTRODUCTION

This Core Operating Limits Report (COLR) for the Perry Nuclear Power Plant (PNPP) Unit 1

Cycle 16 is prepared in accordance with the requirements of PNPP Technical Specification Administrative Control 5.6.5.

The core operating limits presented herein were determined using NRC-approved methods (Obligation 1 and Obligation 2).

The core operating limits for the Global Nuclear Fuel (GNF) fuel in PNPP Unit 1

for Cycle 16 are documented in Obligations 3, 4, 5, 14, 16, and 17 and summarized herein for the following PNPP Unit 1 Technical Specifications:

Average Planar Linear Heat Generation Rate (APLHGR) Limits for each fuel/lattice type, including the power and flow dependent MAPFAC multipliers with the single loop MAPLHGR reduction factor.

All AVERAGE PLANAR LINEAR HEAT GENERATION RATES (APLHGRs) shall not exceed the result obtained from multiplying the applicable MAPLHGR limit, Figure 3.2.1-1a GE14 Fuel Type or Figure 3.2.1-1b GNF2 Fuel Type, by the smaller of either the flow dependent MAPLHGR factor (MAPFACf) or the power dependent MAPLHGR factor (MAPFACp).

MAPLHGR Limits and MAPFACf and MAPFACp are defined in Obligation3.

For Two Loop Operation, MAPFACf and MAPFACp are set equal to 1.0.

For Single Loop Operation, MAPFACf and MAPFACp are set equal to 0.8.

The Single Loop Operation limits take effect when reset for single loop operation per LCO 3.4.1,"Recirculation Loops Operating".

This is consistent with note "(b)" to Table 3.3.1.1-1 of the Technical Specifications.

Use FTI-B0012 Single Loop Operation to implement the revised MAPLHGR Limits.

9 of 23 4.0 MINIMUM CRITICAL POWER RATIO (T.S. 3.2.2)

The MINIMUM CRITICAL POWER RATIO (MCPR) shall be equal to or greater than the higher of the flow dependent MCPR (MCPRf) and power dependent MCPR (MCPRp) limits at the indicated core flow and THERMAL POWER.

The MCPR Safety Limit for Cycle 16 for Two Loop Operation is 1.10 and the MCPR Safety Limit for Single Loop Operation is 1.13 <TECHNICAL SPECIFICATIONS 2.1.1.2> (Obligations 3 and 6).

The change in Safety Limit from Two Loop Operations to Single Loop Operations is accomplished by increasing the Cycle 16 MCPRf and MCPRp limits by 0.03.

3DMONICORE PANACEA Version 11 uses this approach to calculate Single Loop Operation Limits.

The Single Loop Operation limits take effect when reset for single loop operation per LCO 3.4.1,"Recirculation Loops Operating".

This is consistent with note "(b)" to Table 3.3.1.1-1 of the Technical Specifications.

Use FTI-B0012 Single Loop Operation to implement the revised MCPR Limits.

During Two Loop Operation, the resulting limit from MCPRf and MCPRp shall not be less than the OLMCPR of 1.46.

During Single Loop Operation, the resulting limit from MCPRf and MCPRp shall not be less than the OLMCPR of 1.49.

For Cycle 16 no change to MCPR limits is required for planned reduction of feedwater temperature to as low as 325.5°F.

Final feedwater temperature may be reduced to 255.5°F after all control rods are withdrawn at the end of cycle if the OPRMs are OPERABLE.

Planned reduction of rated feedwater temperature from nominal rated feedwater temperature is not permitted during plant operation with the reactor recirculation system in Single Loop Operation.

10 of 23 The 3DMONICORE Computer software should automatically shift between 2 LOOP ON and ONE LOOP ON modes of operation on transfer to Single Loop Operations.

As such the Safety Limit change should occur automatically.

The guidance in FTI-B0012 can be used to verify proper functioning of the 3DMONICORE System.

If the 3DMONICORE System is not functioning properly, FTI-B0012 will implement administrative limits until such time as 3DMONICORE is properly calculating MCPR values.

The MCPRf and MCPRp Limits are based on whether the plant is operating in Two Loop or Single Loop Operations and whether Two Pressure Regulators or One Pressure Regulator is in service.

All LINEAR HEAT GENERATION RATES (LHGRs) shall not exceed the result obtained from multiplying the applicable LHGR limit, Figure 3.2.3-1 a GE14 Fuel Type or Figure 3.2.3-1 b GNF2 Fuel Type, by the smaller of either the flow dependent LHGR factor (LHGRFACf), Figure 3.2.3-2, or the power dependent LHGR factor (LHGRFACp) Figure 3.2.3-3.

LHGR Limits and LHGRFACf and LHGRFACp are defined in Obligations 3, 4,

16, and 17.

For Two Loop Operation, LHGRFACf and LHGRFACp shall not exceed 1.0.

For Single Loop Operation, LHGRFACf and LHGRFACp shall not exceed 0.8.

The Single Loop Operation limits take effect when reset for single loop operation per LCO 3.4.1,"Recirculation Loops Operating".

This is consistent with note "(b)" to Table 3.3.1.1-1 of the Technical Specifications.

Use FTI-B0012 Single Loop Operation to implement the revised MAPLHGR Limits.

Global Nuclear Fuel - Americas AFFIDAVIT I, Lukas Trosman, state as follows:

I am Engineering Manager, Reload Design and

Analysis, Global Nuclear Fuel -

Americas, LLC (GNF-A), and have been delegated the function of reviewing the information described in paragraph (2) which is sought to be withheld, and have been authorized to apply for its withholding.

The information sought to be withheld is contained in Enclosure 1 of GNF's letter, JMT-FEN-KL1-15-049, Jeanne M. Thome to Robert Borland (FirstEnergy Nuclear Operating Company),

GNF proprietary information in Enclosure 1, which is entitled "Perry Nuclear Power Plant Unit 1

Cycle 16 Core Operating Limits Report," is identified by a ((dotted underline inside.double.square brackets^')). A "((" marking at the beginning of a table, figure, or paragraph closed with a "))" marking at the end of the table, figure or paragraph is used to indicate that the entire content between the double brackets is proprietary.

In each case, the superscript notation {3> refers to Paragraph (3) of this affidavit, which provides the basis for the proprietary determination.

In making this application for withholding of proprietary information of which it is the owner or licensee, GNF-A relies upon the exemption from disclosure set forth in the Freedom of Information Act ("FOIA"),

5 USC Sec. 552(b)(4), and the Trade Secrets

Act, 18 USC Sec.
1905, and NRC regulations 10 CFR 9.17(a)(4),

and 2.390(a)(4) for "trade secrets" (Exemption 4).

The material for which exemption from disclosure is here sought also qualify under the narrower definition of "trade secret",

within the meanings assigned to those terms for purposes of FOIA Exemption 4 in, respectively, Critical Mass Energy Project

v. Nuclear Regulatory Commission. 975F2d871 (DC Cir. 1992), and Public Citizen Health Research Group
v. FDA, 704F2dl280 (DC Cir. 1983V (4)

Some examples of categories of information which fit into the definition of proprietary information are:

a.

Information that discloses a

process, method, or apparatus, including supporting data and
analyses, where prevention of its use by GNF-A's competitors without license from GNF-A constitutes a competitive economic advantage over other companies; b.

Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the

design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product; JMT-FEN-KL 1 049 Enclosure 1

c.

Information which reveals aspects of past, present, or future GNF-A customer-funded development plans and

programs, resulting in potential products to GNF-A; d.

Information which discloses patentable subject matter for which it may be desirable to obtain patent protection.

The information sought to be withheld is considered to be proprietary for the reasons set forth in paragraphs (4)a. and (4)b. above.

To address 10 CFR 2.390 (b)

(4), the information sought to be withheld is being submitted to NRG in confidence.

The information is of a sort customarily held in confidence by GNF-A, and is in fact so held.

The information sought to be withheld has, to the best of my knowledge and belief, consistently been held in confidence by GNF-A, no public disclosure has been

made, and it is not available in public sources. All disclosures to third parties including any required transmittals to NRC, have been made, or must be made, pursuant to regulatory provisions or proprietary agreements which provide for maintenance of the information in confidence.

Its initial designation as proprietary information, and the subsequent steps taken to prevent its unauthorized disclosure, are as set forth in paragraphs (6) and (7) following.

Initial approval of proprietary treatment of a document is made by the manager of the originating component, the person most likely to be acquainted with the value and sensitivity of the information in relation to industry knowledge, or subject to the terms under which it was licensed to GNF-A.

The procedure for approval of external release of such a document typically requires review by the staff manager, project manager, principal scientist or other equivalent authority, by the manager of the cognizant marketing function (or his delegate), and by the Legal Operation, for technical content, competitive effect, and determination of the accuracy of the proprietary designation.

Disclosures outside GNF-A are limited to regulatory bodies, customers, and potential customers, and their agents, suppliers, and licensees, and others with a legitimate need for the information, and then only in accordance with appropriate regulatory provisions or proprietary agreements.

The information identified in paragraph (2) is classified as proprietary because it contains details of GNF-A's fuel design and licensing methodology.

The development of the methods used in these

analyses, along with the
testing, development and approval of the supporting methodology was achieved at a

significant cost to GNF-A or its licensor.

Public disclosure of the information sought to be withheld is likely to cause substantial harm to GNF-A's competitive position and foreclose or reduce the availability of profit-making opportunities.

The information is part of GNF-A's JMT-FEN-KL1 049 Enclosure 1

comprehensive BWR safety and technology base, and its commercial value extends beyond the original development cost.

The value of the technology base goes beyond the extensive physical database and analytical methodology and includes development of the expertise to determine and apply the appropriate evaluation process.

In addition, the technology base includes the value derived from providing analyses done with NRC-approved methods.

The research, development, engineering, analytical, and NRC review costs comprise a substantial investment of time and money by GNF-A.

The precise value of the expertise to devise an evaluation process and apply the correct analytical methodology is difficult to quantify, but it clearly is substantial.

GNF-A's competitive advantage will be lost if its competitors are able to use the results of the GNF-A experience to normalize or verify their own process or if they are able to claim an equivalent understanding by demonstrating that they can arrive at the same or similar conclusions.

The value of this information to GNF-A would be lost if the information were disclosed to the public.

Making such information available to competitors without their having been required to undertake a similar expenditure of resources would unfairly provide competitors with a windfall, and deprive GNF-A of the opportunity to exercise its competitive advantage to seek an adequate return on its large investment in developing and obtaining these very valuable analytical tools.
