dated February 9, 2015 Reference 1 describes an NRC-identified finding concerning the Dresden Nuclear Power Station (DNPS), Unit 3 'E' Electromatic Relief Valve's (ERV's) inability to perform its intended safety function. The issue was preliminarily determined to be a White finding. Exelon Generation Company, LLC (EGC) was provided 10 days to choose to: (1) attend a Regulatory Conference, or (2) Submit a position on the finding in writing. In Reference 2, EGC responded in writing stating the intention to provide a written response regarding the preliminary White finding outlined in Reference 1. However, EGC is electing to not provide a position on the finding in writing, and acknowledges that in doing so, the right to appeal the final significance determination for the finding is being relinquished.

EGC understands the importance of the ERVs and recently elected to proactively perform an extent of condition review of the ERVs on DNPS, Unit 2. This occurred during a recent forced outage that began on February 6, 2015 (i.e., D2F56). As a result of the testing, and the stations comprehensive effort to eliminate the design vulnerability, EGC identified a failure of the DNPS, Unit 2 'C' ERV and upgraded the Unit 2 ERVs to the reliable "Hardened" design. At the present time, the DNPS, Unit 2 and Unit 3, ERV actuators have all been replaced with the reliable hardened design.
