Via Reference 1 the NRC conveyed Confirmatory Order EA-12*145 to Southam Nuclear Operating Company, Inc. (SNC). The Order resulted from an alternative dispute resolution (ADA) session addressing issues Involving the failure to ensure that radiation worker training (AWl) exams for security officers were not compromised. Paragraph h in Section V of Order EA-12-145 calls for a review of the effectiveness of corrective actions implemented relative to this event, as follows:
"By August 31, 2014, SNC will conduct an effectiveness review of all corrective actions taken under the Confirmatory Order" A follow-up inspection for this Confirmatory Order was conducted by the NRC in accordance with Inspection Procedure (IP) 92702 and the results are documented in inspection report 05000348/2013005 ; 05000364/2013005 dated February 14, 2014. The inspection assessed the adequacy of implementation of the completed commitments. All of those commitments were closed by that inspection. At the time of the inspection there were two remaining incomplete commitments, which were the Effectiveness Review (Section V paragraph h) and submittal of a letter discussing SNC's basis for concluding that the Order has been satisfied (Section V paragraph j). This letter is notification to the NRC of the completion of the effectiveness review and completes these two remaining commitments.
SNC's corrective action effectiveness review was conducted under its formal corrective action program as Technical Evaluation (TE) 637083 of Condition Report (CR) 635617. This TE was completed on August 29,2014. The
implemented actions to comply with NRC Confirmatory Order No. EA-12-145 were deemed to be effective. This Is based on an evaluation conducted by a cross functional team consisting of members from the Security, Legal, Concerns, and Training departments, and led by Nuclear Licensing and Performance Improvement. The team reviewed CAs, Computer Based Training observations, reported coaching's, interviews, performance plans, and FNP's most recent Nuclear Safety Culture assessment. Additionally the team analyzed results stemming from the SNC Ethics and FNP Mid-cycle INPO surveys to identify potential trust and integrity issues. Occurrences of trust and integrity were defined as events that involved deliberate or wilful misconduct. It was concluded that there Is an overall heightened awareness level to Identify and promptly act upon issues concerning trust and Integrity. The review did not recommend any additional actions.
