Attachment to ET 10-0029 Page 1 of 1 Changes to License Condition 2.C(5)

-By letter dated March 4, 2009 (letter ET 09-0007), Wolf Creek Nuclear Operating Corporation (WCNOC) submitted a license amendment request (LAR) proposing changes to the approved fire protection program as described in the Wolf Creek Generating Station (WCGS) Updated Safety Analysis Report (USAR).

The LAR proposed allowing the performance of operator manual actions, in certain cases, to achieve and maintain safe shutdown in the event of a fire outside of the control room in lieu of meeting the circuit separation protection requirements of 10 CFR 50, Appendix R,Section III.G.2 referenced in Appendix 9.5E of the USAR.

In discussions with the Nuclear Regulatory Commission (NRC) Project Manager, it was identified that NRC approval of the change to the approved fire protection program as described in the WCGS USAR is required to be reflected in License Condition 2.C(5). The proposed deviation requested in Reference 1 is expected to be approved with the issuance of Amendment No. 191 to the Renewed Facility Operating License No. NPF-42.

Proposed changes to Licence Condition 2.C(5) are italicized and underlined.
