SUBJECT:

Beaver Valley Power Station, Unit No. 2 Docket No. 50-412, License No. NPF-73 Revised Commitment Date Relevant to FirstEnergy Nuclear Operating Company Correspondence to the NRC, Dated August 28, 2008 (TAC No. MC4666)

By letter dated August 28, 2008 (Reference 1), FirstEnergy Nuclear Operating Company (FENOC) provided an extension request for completion of certain corrective actions related to Generic Letter (GL) 2004-02 (Reference 2) for Beaver Valley Power Station Unit No. 1 (BVPS-1) and Unit No. 2 (BVPS-2). The Nuclear Regulatory Commission (NRC) evaluated and approved the due date extension for completion of the corrective actions until startup following the spring 2009 refueling outage for BVPS-1 and March 31, 2009 for BVPS-2 in a letter dated September 30, 2008 (Reference 3).

In the August 28, 2008 letter, FENOC committed to submit to the NRC a follow-up supplemental response to Generic Letter 2004-02 including the results of BVPS-2 debris and chemical effects testing, results of downstream effects analyses, the effects on net positive suction head (NPSH) margins, and details of corrective actions by April 30, 2009. The debris and chemical effects testing was not completed on schedule, because additional testing was needed to identify debris loading levels that would result in acceptable head loss. Consequently, FENOC is submitting a revised supplemental response submittal date of June 30, 2009 as presented below.

A follow-up supplemental response to Generic Letter 2004-02 including the results of BVPS-2 debris and chemical effects testing (which will include credit for containment overpressure), results of downstream effects analyses (both in-vessel and ex-vessel),

the effects on NPSH margins, and details of corrective actions will be submitted to the NRC by June 30, 2009. This commitment supersedes commitment number 3 listed in Attachment 2 of the August 28, 2008 letter.

Beaver Valley Power Station, Unit No. 2 L-09-060 Page 2 The revised due date for this specific item does not reflect a change to the final completion due date for corrective actions related to Generic Letter 2004-02.

A list of the regulatory commitments made in this submittal is provided in the Attachment to this letter. If there are any questions, or if additional information is required, please contact Mr. Thomas A. Lentz, Manager - Fleet Licensing, at 330-761-6071.

I declare under penalty of perjury that the foregoing is true and correct. Executed on (Month) 310_, 2009.
