SUBJECT:

STAFF REQUIREMENTS - BRIERIl ON STATUS OF EFFORTS TO ENHANCE SAFETY OF USERS OF BY-PRODUCT MATERIALS, 10:00 A.M., FRIDAY, AUGUST 5, 1988, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)

The Commission was briefed by the staff on the status of implementing the recommendations made by the Materiais Safety Regulations Review Study Group on enhancina safety of users of by-product materials.

Chairman Zech made the following requests:

1. Following completion of the regional pilot program on materials licensees, the staff should submit a report on the recommendations and lessons learned from the pilot program, (EDO) (SECY Suspense: TED) i
2. The staff should submit a Commission paper outlining the issues which will not be addressed given the staff's proposed $300,000 reduction in the NMSS budget for the general licensee mail survey. Chairman Zech emphasized the importance for the Commission to establish a system of nuclear materials accounting.

Commissioner Carr requested the staff to:

1. Submit an information paper describing the pilot performance evaluation factors program for material licensees. The paper should describe the evaluation factors, the results obtained from Region III's pilot program, and details for implementing the pilot programs at the other regions.

2. Submit a paper describing: (1) the training program curriculum for material licensee inspectors, and (2) staff's program for NRC material licensing officials to periodically conduct inspections and thereby maintain greater field familiarity and sensitivity to problems.

3. Report to the Commission on the apparent inconsistency between the Special Analysis on the Five-Year Plan which specifies a reduction in resources for safety inspections or safety assessments and the staff's discussion of emphasizing enhanced safety assessments. The resources to be expended to this program should be clearly addressed.

4. Broaden the distribution of the NMSS Licensee Newsletter not only to the medical societies, but to other professional societies as well.
5. Staff should cooperate fully with states wishing to apply for agreement state status, but should not be proactive in encouraging states that do not want agreement state status or may be concerned about meeting financial commitments which go along with such status.
