SUMMARY

OF MAY 2,2013, MEETING WITH DUKE ENERGY CONCERNING THE RELOCATION OF THE EMERGENCY OPERATING FACILITIES (TAC NOS. MF1447, MF1448, MF1449 AND MF1450)

On May 2,2013, the Nuclear Regulatory Commission (NRC) staff conducted a Category 1 public meeting via teleconference call with Duke Energy Inc., which is representing Carolina Power & Light Company, the licensee for Brunswick Steam Electric Plant, Units 1 and 2 (Brunswick); H.B. Robinson Steam Electric Plant, Unit No.2 (HBRSEP) and Shearon Harris Nuclear Power Plant, Unit 1 (Harris); at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was for Duke Energy to discuss its proposed license amendment request (LAR) for the relocation of the emergency operations facilities (EOFs) for Brunswick, HBRSEP and Harris. The meeting notice was publicly available on the NRC's website and is documented in the NRC's Agencywide Documents Access and Management System at Accession No. ML13106A337. The list of participants for the meeting are provided in the enclosure to the meeting summary.

During the conference call, the licensee indicated its plans to merge the EOFs for Brunswick, HBRSEP and Harris to Charlotte, North Carolina, where the licensee's headquarters are located. The licensee stated that the purpose for the relocation of the EOFs would be to provide move continuity during emergency response events and to increase the efficiency of common site procedures.

During the conference call, the NRC staff discussed its overall expectation of the LAR, scheduling, and asked a few clarification questions. The NRC staff discussed with the licensee, that the LAR review process includes the acceptance review, requests for additional information, Commission approval, and the development of the safety evaluation.

Specifically, the NRC staff indicated that Title 10 of the Code of Federal Regulations (10 CFR)

Part 50, Appendix E, "Emergency Planning and Preparedness for Production and Utilization Facilities," specifies the requirements for emergency facilities and equipment. The NRC staff indicated that a licensee desiring to locate an EOF more than 25 miles from a nuclear power reactor site(s) must request Commission prior approval. The NRC staff also indicated to the licensee that the proposed LAR should provide a justification for: (1) the changes to the emergency plan according to the requirements of 10 CFR 50.47; (2) the approval from the Federal Emergency Management Agency and State officials; (3) and single unit and multi-unit emergency event scenarios.

In terms of scheduling, the licensee is planning to submit the LAR for Brunswick, HBRSEP and Harris for NRC staff review by December 2013 or January 2014. The NRC staff also indicated to

-2 the licensee that the overall review of the LARs could take more than 1 year, which includes an NRC-observed, performance-based, verification and validation exercise of the new EOF.
