Items of Interest Week Ending August 5, 2022 NRC Public Meetings with TerraPower on Topical Reports On August 4, the U.S. Nuclear Regulatory Commission (NRC) staff hosted two virtual public meetings with TerraPower to discuss forthcoming topical reports on regulatory applicability and emergency preparedness methodology. TerraPower intends to submit these topical reports as part of its pre-application engagement activities supporting the Natrium sodium fast reactor design that would be sited in Kemmerer, WY. TerraPower anticipates submitting its construction permit application for the Natrium reactor in August 2023. Approximately 60 stakeholders attended both meetings, including representatives from non-governmental organizations, congressional offices, advanced reactor vendors, and members of the public. The NRC staff posed several questions to TerraPower during both meetings and also addressed questions and comments from external stakeholders following the business portion of each meeting.
NRC Participates in the 2022 Nuclear Energy Institute Radiation Protection Forum From August 1 to August 3, 2022, NRR and regional staff participated in the 2022 Nuclear Energy Institute Radiation Protection Forum in Las Vegas, NV. This meeting was attended by radiation protection leaders from the commercial nuclear power industry and fuel cycle facilities as well as representatives from the Nuclear Suppliers Association, American Nuclear Insurers, the Health Physics Society, the Electric Power Research Institute, and the Institute of Nuclear Power Operations. NRC staff made plenary presentations and participated in breakout sessions and panel discussions. During the plenary presentation, staff discussed updates to Regulatory Guides, inspection guidance documents and rulemakings. During the breakout sessions and panel discussions, the staff responded to questions from the audience regarding inspection practices/observations and various technical issues concerning radiation protection.
Staff also discussed technical issues concerning the calibration of installed radiation monitors that are used to measure reactor plant effluents and in emergency response decision making.
NRC Issues 10 CFR 52.103(g) Finding for Vogtle Unit 3 On August 3, 2022, the NRC issued the Title 10 of the Code of Federal Regulations (10 CFR) 52.103(g) finding for Vogtle Unit 3. The finding is based on the staffs determination that Southern Nuclear Operating Company (SNC) successfully completed all of the inspections, tests, analyses, and acceptance criteria in Appendix C of the Vogtle Unit 3 combined license.
This finding, the first ever to be issued under the Part 52 licensing process, allows SNC to load fuel and begin operation of Vogtle Unit 3 in accordance with the terms and conditions of the license.
NRC Public Meeting on 10 CFR Part 53 Advanced Reactors Rulemaking On July 28, 2022, the NRC staff held a public meeting on the 10 CFR Part 53 risk-informed, technology-inclusive regulatory framework for advanced reactors rulemaking (Agencywide Document Access and Management System (ADAMS) Accession No. ML22195A005). NRC staff summarized its progress on the development of preliminary proposed rule language for Framework B, including the Alternate Evaluation for Risk Insights (see ADAMS Accession Nos. ML22145A000, ML22160A039, ML22146A045, and ML22146A041), and discussed its consideration of Framework B feedback received to date. External stakeholders provided additional feedback on specific Framework B subparts as well as on topics, such as the incorporation of performance-based approaches, the use of quantitative health objectives, and the as low as reasonably achievable dose objectives. In response to continued stakeholder interest in open dialog on Part 53, the NRC staff plans to include the Part 53 rulemaking in the agenda for the next periodic advanced reactor stakeholder meeting planned for August 18, 2022.
Florida Power & Light Company Submits Digital Instrumentation and Control License Amendment Request for Turkey Point On July 30, 2022, Florida Power & Light Company submitted license amendment requests to replace the reactor protection system, engineered safety features actuation system, and nuclear instrumentation system with digital systems that are based on the Framatome Tricon Programmable Logic Controller Version 10 digital based platform at Turkey Point Nuclear Plant, Units 3 and 4. The licensee stated that the format and contents of the amendment requests are consistent with Digital Instrumentation and Control Interim Staff Guidance 06. The licensee requested NRC approval of the proposed license amendment requests by the second quarter of calendar year 2024. As part of the acceptance review of the amendment requests, the NRC staff will develop a review schedule.

On August 5, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 47947) correcting the notification published in the Federal Register on July 19, 2022 (87 FR 42969), regarding reopening the comment period and correcting a publication error for a regulatory basis to support a rulemaking that would amend its regulations for decommissioning financial assurance for sealed and unsealed radioactive materials. This action is necessary to correct the information for the NRC's Public Document Room. The correction was effective August 5, 2022.

Items of Interest August 5, 2022 Information and Records Management (IRM) Policy and Compliance Support On July 29, 2022, contract number 31310022C0022 was awarded to Dynamic Business Group, Inc. in Hanover, MD. The purpose of this contract is to acquire Information and Records Management (IRM) Policy and Guidance support to the U.S. Nuclear Regulatory Commission.
The contractor shall support tasks related to developing new/updated policies, guidance, and procedures, especially in developing functional records retention schedules and file plans. The period of performance is from July 31, 2022, through July 30, 2023, with four option periods.
The total potential value of the contract can be up to $1,097,327.16.
