Items of Interest Week Ending August 27, 2021 Issuance of Closeout Letter for Bulletin 2012-01, Design Vulnerability in Electric Power System, for Joseph M. Farley Nuclear Plant, Units 1 and 2 On August 23, 2021, the NRC staff issued a closeout letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21216A316) for Bulletin 2012-01, Design Vulnerability in Electric Power System (ADAMS Accession No. ML12074A115) for Joseph M. Farley Nuclear Plant, Units 1 and 2 (Farley). The NRC staff reviewed and accepted the information submitted by Southern Nuclear Operating Company and incorporated the results of NRCs Temporary Instruction 2515/194 inspection for Farley in reaching its closeout conclusion.
Issuance of Waterford 3 Digital Instrumentation and Control (DI&C) Amendment On August 24, 2021, the NRC staff issued Waterford 3 digital instrumentation and control (DI&C) amendment (ADAMS Accession No. ML21131A243). This is the first application that the NRC approved using the alternate review process in DI&C Interim Staff Guidance 06, Revision 2, Digital Instrumentation and Controls Licensing Process, Interim Staff Guidance (ML18269A259). The amendment revises various technical specifications in order for the licensee to implement a digital upgrade to its core protection calculator system. The NRC staff's review addressed potential common cause failures by verifying that backup trip functions demonstrate adequate defense-in-depth commensurate with the risk-significance of the digital upgrade.
Submittal of Nuclear Energy Institute (NEI) 21-06 Guidelines for 10 CFR 50.59 Implementation at Non-Power Production or Utilization Facilities [NPUFs] for Endorsement by the NRC On August 23, 2021, NEI, on behalf of the National Organization of Test, Research, and Training Reactors (TRTR), submitted NEI 21-06 Guidelines for 10 CFR 50.59 Implementation at Non-Power Production or Utilization Facilities [NPUFs] for endorsement by the NRC. This document represents a multi-year effort by the TRTR community with significant engagement from NRC staff to develop guidance related to compliance with the regulations in Title 10 Code of Federal Regulations, Section 50.59, changes, tests and experiments, emphasizing aspects specific to NPUFs. Endorsement of the document is expected to benefit both the TRTR community and the NRC staff. The NRC staff will issue a letter allowing licensees to use the guidance while the document is under the regulatory guide process.
NRC Granted Exemption to Wolf Creek Regarding the Performance of the Calendar Year 2021 Full-Participation Biennial Emergency Preparedness Exercise On August 25, 2021, the NRC staff granted a temporary exemption (ADAMS Accession No. ML21225A024) to Wolf Creek from Appendix E to 10 CFR Part 50, Sections IV.F.2.b and IV.F.2.c, regarding the performance of the calendar year 2021 full-participation biennial emergency preparedness exercise. This request was submitted by Wolf Creek (ADAMS Accession No. ML21210A450) and is related to COVID-19. The staff reviewed the exemption and determined that it should be granted pursuant to 10 CFR 50.12, because the exemption is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest.

NRC Conducted Public Meeting with the Industrys Reactor Oversight Process Task Force and Members of the Public On August 26, 2021, the NRC hosted a public meeting with the industrys Reactor Oversight Process (ROP) Task Force and members of the public to discuss topics that included: the withdrawal of SECY-18-0113, Recommendations for Modifying the Reactor Oversight Process Engineering Inspection, and SECY-19-0067, Recommendations for Enhancing the Reactor Oversight Process (ADAMS Accession No. ML21236A306); follow-on COVID lessons learned activities; NEIs plans for reporting guidance applicable to plants with risk-informed licensing bases; and 10 CFR 50.72(b) rulemaking (ADAMS Accession No. ML21236A130). This meeting was well-attended by industry and members of public, with insightful discussion on the next steps for future public interaction. The next monthly public meeting between the staff and the ROP Task Force is scheduled for September 23, 2021.
NRC Hosted an Advanced Reactor Stakeholder Meeting to Discuss Regulatory Improvements to Support the Licensing of Advanced Reactors On August 26, 2021, the NRC hosted an Advanced Reactor Stakeholder Meeting with over 200 stakeholders on regulatory improvements to support the licensing of advanced reactors.
Discussion topics included Part 71 transportation requirements for micro-reactors, material control and accounting of special nuclear material of moderate strategic significance (Category II material), results of the U.S. Nuclear Industry Councils 2021 Advanced Nuclear Survey, role and use of probabilistic risk assessment (PRA) in support of advanced reactor licensing, status of non-light water reactor PRA acceptability regulatory guide, draft white paper on in-service inspection and in-service testing guidance, and an update on the advanced reactor exports working group report. This meeting was in support of Strategy 1 (knowledge management),
Strategy 3 (regulatory framework), and Strategy 5 (resolution of policy issues) of the Advanced Reactor Implementation Action Plans.

Items of Interest Week Ending August 27, 2021 Miscellaneous Corrections: Final Rule; Correction; 10 CFR Chapter I (NRC-2021-0113; RIN 3150-AK65)
On August 24, 2021, the NRC published a notice in the Federal Register (86 FR 47209) correcting a final rule that was published in the Federal Register on August 9, 2021 (86 FR 43397). The rule amended NRCs regulations to make miscellaneous corrections, remove outdated reporting requirements, clarify language, add metric units, and insert missing language. This action is necessary to correct inadvertent errors in the final rule. The correction takes effect on August 24, 2021.
NuScale Small Modular Reactor Design Certification: Proposed Rule; Extension of Comment Period; 10 CFR Part 52 (NRC-2017-0029; RIN 3150-AJ98)
On August 24, 2021, the NRC published a notice in the Federal Register (86 FR 47251) extending the comment period for proposed amendments to its regulations to certify the NuScale standard design for a small modular reactor. The public comment period for the notice published on July 1, 2021 (86 FR 34999), was originally scheduled to close on August 30, 2021 but the NRC has decided to extend the public comment period by an additional 45 days to allow more time for members of the public to develop and submit their comments. The comment period for the document published on July 1, 2021 is extended, and comments should be filed no later than October 14, 2021.
Categorical Exclusions from Environmental Review: Advance Notice of Proposed Rulemaking; Reopening of Comment Period; 10 CFR Part 51 (NRC-2018-0300; RIN 3150-AK54)
On August 23, 2021, the NRC published a notice in the Federal Register (86 FR 47032) to reopen the public comment period for the advance notice of proposed rulemaking that was published in the Federal Register on May 7 (86 FR 24514), which requested public comment on the agencys plan to amend its regulations on categorical exclusions for licensing, regulatory, and administrative actions that individually or cumulatively do not have a significant effect on the human environment. The public comment period closed on July 21, 2021. The NRC has decided to reopen the public comment period to allow more time for members of the public to develop and submit their comments. The comment period for the advance notice of proposed rulemaking published on May 7, 2021, is re-opened and now closes on September 21, 2021.

NRC Hosted a Public Meeting on the Draft Environmental Impact Statement for the Westinghouse Columbia Fuel Fabrication Facility On August 26, 2021, the NRC staff held a public meeting via webinar and teleconference on the draft environmental impact statement (EIS) for the Westinghouse Columbia Fuel Fabrication Facility (CFFF) in Richland County, South Carolina (ADAMS Accession No. ML21209A213).
The public meeting lasted three hours and approximately 85 individuals participated, with 16 people providing verbal comments. Comments that were in opposition to the 40-year license renewal of the CFFF focused primarily on contamination concerns and safe operations of the facility. Other comments were related to environmental justice, radiological health and safety, contamination of water resources, and climate change. The 45-day public comment period ends September 20, 2021.

The purpose of this contract is to commission a feasibility study of using virtual reality, augmented reality, and mixed reality to create learning experiences for NRC staff.
The period of performance is from August 20, 2021, through February 28, 2023 with no option periods. The total potential value of the contract can be up to $673,025.34.
NRC Awarded Contract for Budget Formulation System (BFS) Operations, Maintenance and Enhancement Contractor Support On August 23, 2021, contract number GS35F291CA/31310021F0094 was awarded to Huron Consulting Services, LLC, in Chicago, IL. The purpose of this contract is to acquire services to assist the NRC with maintaining and enhancing operational efficiency of the NRCs Oracle EPM cloud applications and its supporting environments. The period of performance is from September 15, 2021, through September 14, 2022, with four (4) option periods. The total potential value of the contract can be up to $3,640,529.13.
NRC Awarded Contract for IBM Software Support and Licenses On August 25, 2021, contract number NNG15SC73B/31310021F0107 was awarded to Four, LLC, in Herndon, VA. The purpose of this contract is to procure IBM software, products, licenses, services, and support. The period of performance is from January 1, 2022, through December 31, 2022, with no option periods. The total potential value of the contract can be up to $1,190,478.37.
NRC Awarded Contract for Adobe Software Licenses and Support On August 24, 2021, contract number NNG15SD09B/31310021F0087 was awarded to Bahfed Corp. in Portland, OR. The purpose of this contract is to procure Adobe Systems software licenses and support. The period of performance is from November 17, 2021, through November 16, 2022, with no option periods. The total potential value of the contract can be up to $721,891.11.
