Items of Interest Week Ending August 20, 2021 NRC Held Technology Update Meeting with GE-Hitachi Nuclear Energy Americas, Global Nuclear Fuel On August 17, 2021, the Nuclear Regulatory Commission (NRC) staff held a virtual closed technology update meeting with GE-Hitachi Nuclear Energy (GEH)/Global Nuclear Fuel (GNF).

During the meeting, GEH/GNF presented proprietary information regarding various topics related to fuel performance and future plans.

NRC Participated in the PWR Owners Group Risk Management Committee Meeting On August 18, 2021, the NRC staff presented at the PWR Owners Group Risk Management Committee meeting (Agencywide Documents Access and Management System Accession No. ML21231A167). Subjects included the risk-informed process for evaluations, the treatment of FLEX in licensing actions, potential endorsement of the Institute of Electrical and Electronic Engineers (IEEE) 1819-2016 - IEEE Standard for Risk-Informed Categorization and Treatment of Electrical and Electronic Equipment at Nuclear Power Generating Stations and Other Nuclear Facilities (which covers risk informed categorization and treatment of electrical and electronic equipment at nuclear plants and facilities), and areas for consideration in future updates to Regulatory Guide 1.201, Guidelines for Categorizing Structures, Systems, and Components in Nuclear Power Plants According to Their Safety Significance.

Items of Interest Week Ending August 20, 2021 Linear No-Threshold Model and Standards for Protection Against Radiation; Petition for Rulemaking; Denial; 10 CFR Part 20 (Docket Nos. PRM-20-28, PRM-20-29, and PRM-20-30; NRC-2015-0057)

On August 17, 2021, the Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 45923) denying three petitions for rulemaking (PRMs), submitted by Dr. Carol S. Marcus, Mr. Mark L. Miller, Certified Health Physicist, and Dr. Mohan Doss, et al.

(collectively, the petitioners) in correspondence dated February 9, 2015, February 13, 2015, and February 24, 2015, respectively. The petitioners requested that the NRC amend its regulations based on what they assert is new science and evidence that contradicts the linear no-threshold (LNT) dose-effect model that serves as the basis for the NRCs radiation protection regulations.

The NRC docketed these petitions on February 20, 2015, February 27, 2015, and March 16, 2015, and assigned them Docket Numbers PRM-20-28, PRM-20-29, and PRM-20-30, respectively. The NRC is denying the three petitions because they fail to present an adequate basis supporting the request to discontinue use of the LNT model. The NRC has determined that the LNT model continues to provide a sound regulatory basis for minimizing the risk of unnecessary radiation exposure to both members of the public and radiation workers. The dockets for PRM-20-28, PRM-20-29, and PRM-20-30 were closed on August 17, 2021.

NRC Held a Public Meeting on the Indian Point Post-Shutdown Decommissioning Activities Report On August 18, 2021, the NRC staff held a follow-up virtual meeting to the July 29, 2021, Post Shutdown Decommissioning Activities Report public meeting for the Indian Point facility (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21218A022). There were approximately 22 participants, 9 of whom provided comments.

Comments primarily focused on concerns regarding integrity of independent spent fuel storage installations, safety of the gas pipeline with spent fuel in storage and decommissioning activities, and groundwater contamination. Other comments were related to concerns about the ability to complete decommissioning of the site, use and adequacy of the decommissioning trust fund, and need for a full-time resident inspector onsite.

NRC Held a Public Meeting on the Retrospective Review of Administrative Requirements Initiative On August 19, 2021, the NRC staff held an information public meeting on the Retrospective Review of Administrative Requirements (RROAR) initiative (ADAMS Accession No. ML21208A374). This meeting was a follow-up to the June 30, 2021, public meeting to further discuss the results of RROAR including providing additional detail on how the Commission-approved RROAR screening criteria were applied in assessing comments collected from both NRC staff and external stakeholders and describing how the assessment results were documented in SECY-21-0056, Evaluation of Stakeholder Input on Retrospective Review of Administrative Requirements - May 2021 (ADAMS Accession No. ML21013026). The NRC staff also addressed questions from the public on the assessment results. The meeting was attended by over 50 individuals, representing the Nuclear Energy Institute, several nuclear power utilities, Senate committee staff, and members of the public. The NRC staff will use feedback from this meeting to inform the development of future rulemaking plans.
