Items of Interest Week Ending August 13, 2021 CNSC-NRC Joint Report Regarding X-energy's Xe-100 RPV Construction Code Assessment White Paper On August 11, 2021, the Nuclear Regulatory Commission (NRC) and the Canadian Nuclear Safety Commission (CNSC) publicly released the first joint report developed under the Memorandum of Collaboration in pre-licensing review activities for advanced reactors. The report documents the results of the collaborative activities between the NRC and CNSC staff to respond to X-energys request for informal feedback on its reactor pressure vessel construction code assessment for its Xe-100 design (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21166A304). The report will be posted on NRCs public webpage https://www.nrc.gov/docs/ML2116/ML21166A304.html.

NRC Issued Information Notice Operating Experience Related to the Duane Arnold Energy Center Derecho Event of August 10, 2020 On August 11, 2021, the NRC issued an Information Notice (IN) Operating Experience Related to the Duane Arnold Energy Center Derecho Event of August 10, 2020 (ADAMS Accession No. ML21139A091). This IN provides risk and operational insights to operating power reactor licensees from the NRCs risk-informed decision-making analysis related to this severe weather event at Duane Arnold.

NRC Staff Participated in the Annual Nuclear Energy Institute Regulatory Affairs Forum On August 10-12, 2021, the NRC staff participated in the annual Nuclear Energy Institute Regulatory Affairs Forum through various presentations and panels. Topics included NRCs priorities and perspectives including the NRC programs for risk-informed decision making, digital instrumentation and controls, accident tolerant fuel, and the operating reactor licensing and oversight programs. The NRC staff also presented on a variety of technology initiatives and participated in a breakout session to address questions from the forum participants.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending August 13, 2021 NRC Issued an Amendment to the Physical Security Plan for Pilgrim On August 5, 2021, the Nuclear Regulatory Commission (NRC) staff issued an amendment to the Pilgrim Nuclear Power Station that approved the Physical Security Plan for the Independent Spent Fuel Storage Installation (ISFSI) -only status (Agencywide Documents Access and Management System Accession No. ML21217A175). The implementation of the proposed changes is predicated upon the completion of the transfer of all spent fuel to dry storage in casks within the ISFSI. Implementation of the proposed changes also requires the installation or modification of those security structures, systems, and components necessary to support the ISFSI-only plan. Additionally, the implementation of the proposed changes requires appropriate security measures to be in place during the transition from the current Plan to the ISFSI-only plan.

Miscellaneous Corrections: Final Rule;10 CFR Chapter I [NRC-2021-0113; RIN 3150-AK65]

On August 9, 2021, the NRC published a notice in the Federal Register (86 FR 43397) amending its regulations to make miscellaneous corrections. These changes include correcting mailing addresses, typographical errors, grammatical errors, references, spelling, agency names, and office titles; removing outdated reporting requirements; clarifying language; adding metric units; and inserting missing language. This document is necessary to inform the public of these non-substantive amendments to the NRCs regulations. This final rule is effective September 8, 2021.

Protection of Digital Computer and Communication Systems and Networks: Petition for Rulemaking; Denial; 10 CFR Part 73 [Docket No. PRM-73-18; NRC-2014-0165]

On August 10, 2021, the NRC published a notice in the Federal Register (86 FR 43599) denying a petition for rulemaking (PRM), dated June 12, 2014, submitted by Anthony Pietrangelo on behalf of the Nuclear Energy Institute (NEI). The petitioner requested that the NRC amend its power reactor cyber security regulations to make them consistent with the original intent of the rule and clarify that the scope of those regulations only requires the protection of those digital assets that can directly cause core damage and spent fuel sabotage, or whose failure would cause a reactor scram. The petition was docketed by the NRC on September 22, 2014, and was assigned Docket No. PRM-73-18. The NRC staff has determined that the information presented in PRM-73-18 does not support rulemaking. The docket for the petition for rulemaking, PRM-73-18, closed on August 10, 2021.

NRC Issued Preliminary Evaluation of Extravasation and Medical Event Reporting On August 11, 2021, the NRC staff made publicly available their preliminary evaluation of extravasation and medical event reporting (ADAMS Accession No. ML21223A085), and the associated draft recommendation report by the Advisory Committee on the Medical Uses of Isotopes (ACMUI) Subcommittee on Extravasation. These documents will be available on the NRC public ACMUI website: https://www.nrc.gov/reading-rm/doc-collections/acmui/meetings/2021.html. The documents are being released in preparation for the ACMUIs September 2, 2021, public meeting on extravasations, details of which are available on the NRCs public website: https://www.nrc.gov/pmns/mtg?do=details&Code=20210833.

Advanced Boiling Water Reactor Design Certification Renewal: Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 52 [NRC-2017-0090; RIN 3150-AK04]

On August 12, 2021, the NRC published a notice in the Federal Register (86 FR 44262) confirming the effective date of September 29, 2021, for the direct final rule that was published in the Federal Register (86 FR 34905) on July 1, 2021. This direct final rule amended NRCs regulations to certify the U.S. Advanced Boiling Water Reactor (ABWR) standard design so that applicants intending to construct and operate a U.S. ABWR standard design may do so by referencing the design certification rule. The effective date of September 29, 2021, for the direct final rule published on July 1, 2021, is confirmed.

List of Approved Spent Fuel Storage Casks: TN Americas LLC NUHOMS EOS Dry Spent Fuel Storage System, Certificate of Compliance No. 1042, Amendment No. 2; Direct Final Rule; 10 CFR Part 72 [NRC-2021-0124; RIN 3150-AK66]

On August 12, 2021, the NRC published a notice in the Federal Register (86 FR 44262) amending its spent fuel storage regulations by revising the TN Americas LLC, NUHOMS EOS Dry Spent Fuel Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 2 to Certificate of Compliance No. 1042. Amendment No. 2 revises the certificate of compliance to add a dry shielded canister for storage, add new heat load zone configurations, and make other changes to the storage system. Amendment No. 2 also changes the certificate of compliance, technical specifications, and updated final safety analysis report for consistency and clarity. The companion proposed rule was also published in the Federal Register on August 12, 2021 (86 FR 44296). This direct final rule is effective October 26, 2021.

Elimination of Immediate Notification Requirements for Nonemergency Events: Petition for Rulemaking; Consideration in the Rulemaking Process; 10 CFR Part 50 [Docket No.

PRM-50-116; NRC-2018-0201]

On August 12, 2021, the NRC published a notice in the Federal Register (86 FR 44290) announcing that it will consider in its rulemaking process issues raised in a PRM, dated August 2, 2018, submitted by Mr. Bill Pitesa on behalf of NEI. The petition was docketed by the NRC on November 20, 2018, and was assigned Docket No. PRM-50-116. The petitioner requested that the NRC amend its regulations to eliminate immediate notification requirements for nonemergency events for operating nuclear power reactors. The NRC will evaluate the current requirements and guidance for immediate notification of nonemergency events for operating nuclear power reactors, assess whether the requirements present an unnecessary reporting burden, and if they do, determine whether reporting that does not have a commensurate safety benefit can be reduced or eliminated. The docket for the petition for rulemaking, PRM-50-116, is closed on August 12, 2021.

List of Approved Spent Fuel Storage Casks: TN Americas, LLC, Standardized Advanced NUHOMS Horizontal Modular Storage System, Certificate of Compliance No. 1029, Renewal of Initial Certificate and Amendment Nos. 1, 3, and 4; 10 CFR Part 72; Direct Final Rule [NRC-2021-0108; RIN 3150-AK64 On August 13, 2021, the NRC published a notice in the Federal Register (86 FR 44594) amending its spent fuel storage regulations by revising the TN Americas, LLC, Standardized Advanced NUHOMS Horizontal Modular Storage System listing within the List of approved spent fuel storage casks to renew, for an additional 40 years, the initial certificate and Amendment Nos. 1, 3, and 4 of Certificate of Compliance No. 1029. The renewal revises the AUGUST 24, 2021 ENCLOSURE D

certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The companion proposed rule was also published in the Federal Register on August 13, 2021 (86 FR 44652). This direct final rule is effective October 27, 2021.

Revision of Fee Schedules: Fee Recovery for Fiscal Year 2021; Final Rule; Delay of Effective Date; 10 CFR Parts 15, 170, and 171 [NRC-2018-0292; RIN 3150-AK24]

On August 13, 2021, the NRC published a notice in the Federal Register (86 FR 44594) to delay the effective date of the final rule published in the Federal Register (86 FR 32146) on June 16, 2021, that amends its regulations pertaining to user fees and annual fees charged to its applicants and licensees. These amendments are necessary to implement the Nuclear Energy Innovation and Modernization Act, which, beginning with fiscal year 2021, requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee recovery requirement. In addition, the final rule also included improvements associated with fee invoicing to implement provisions of the Nuclear Energy Innovation and Modernization Act. The final rule had an original effective date of August 16, 2021. This document delays the effective date of the rule to August 20, 2021, to ensure that the rule has the 60-day delayed effective date required by the Congressional Review Act. As of August 13, 2021, the effective date of the rule amending Title 10 of the Code of Federal Regulations parts 15, 170, and 171 is delayed until August 20, 2021.
