Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending JULY 9, 2021 NRC Issued License Amendment for Farley Nuclear Power Plant Units 1 and 2 On June 30, 2021, the NRC issued amendments for Farley Nuclear Plant, Units 1 and 2 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21137A247) to Southern Nuclear Operating Company (SNC) for its request to modify the licenses for Farley, Units 1 and 2, in response to its application dated June 18, 2020 (ADAMS Accession No. ML20170B114), as supplemented by letter dated March 2, 2021 (ADAMS Accession No. ML21064A526). The two amendments allow the implementation of the provisions of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors. The amendments also add a license condition to the renewed facility operating licenses that was proposed by SNC. The license condition identifies action items that need to be completed prior to implementing 10 CFR 50.69 at Farley, Units 1 and 2, and identifies possible changes to the categorization process that would require prior NRC approval.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending JULY 9, 2021 NRC Held Public Meeting to Discuss Extreme Environmental Phenomena During Independent Spent Fuel Storage Cask Loading Campaigns On July 7, 2021, the NRC staff held a public meeting with Holtec International (Holtec) and nuclear industry representatives (Agencywide Documents Access and Management System Accession No. ML21188A203). The purpose of the meeting was for stakeholders to provide the NRC greater context and additional information related to extreme environmental phenomena during transient or transitional evolutions that occur during short-term operations at independent spent fuel storage installation cask loading campaigns. Holtec communicated their approach to addressing the relative risk from tornado missiles during transient operations. The NRC staff valued the industrys openness and committed to evaluate and address the industrys concerns.

Office of Enforcement (OE)

Items of Interest Week Ending JULY 9, 2021 Decision Issued on Differing Professional Opinion Appeal On June 8, 2021, the Executive Director for Operations (EDO) issued a decision on the appeal of a Differing Professional Opinion (DPO) submitted on August 5, 2020. The DPO raised concerns with the regulatory basis documented in the staffs safety evaluation report (SER) related to the subsequent license renewal of Surry Power Station, Units 1 and 2. An ad-hoc review panel was formed and tasked by the NRC Differing Views Program to review the DPO.

The DPO Panel subsequently issued their findings report to the Director of the Office of Nuclear Reactor Regulation (NRR) on December 21, 2020. The DPO decision was issued on January 28, 2021.

On February 18, 2021, the DPO submitter appealed to the EDO regarding the DPO decision.

This appeal stated four continuing concerns: 1) the agency has set a precedent by deferring to the licensees corrective action program, 2) there is a lack of current licensing basis clarity due to the deferral to the corrective action program in the Surry SER, 3) RIS 2014-06 does not need to be revised, and 4) newly identified operating experience shows that aging management is needed at Surry. The Director of NRR issued her statement of views on March 26, 2021. The EDOs decision on the DPO appeal concluded that although there were deficiencies in the review of the Surry subsequent license renewal application, no additional actions are needed with regard to the Surry SER. However, the EDO directed NRR to evaluate and update guidance to provide clarity on how to address late-breaking operating experience; provide training to staff to ensure common understanding on how to review complex assemblies, the disposition of operating experience related to complex assemblies, and how to document deviations from guidance; and update guidance to provide additional clarity on how to address complex assembly operating experience that occurs in all stages (beginning, middle and late) in the license renewal process.
