Items of Interest Week Ending JUNE 4, 2021 NRC Held Public Meeting on August 2020 Derecho Risk Insights On May 27, 2021, the NRC conducted a public meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21146A208) with industry representatives to exchange information pertaining to risk insights obtained from reviews of the Duane Arnold Energy Center (DAEC) derecho on August 10, 2020. Specifically, the NRC staff discussed NRCs regulatory response resulting from the event. The meeting objective was to share information related to the event that could further enhance licensees response to similar severe weather events. The meeting had an interactive panel session that provided an exchange of information. Several members of the public asked questions supporting further dialogue on ongoing NRC activities related to severe weather events, including issuing an Information Notice in 2021 on the risk insights following the DAEC evaluation.

NRC Withdraws Indian Point Generating Unit 3 Interim Compensatory Measure On May 28, 2021, the staff issued a determination letter to Entergy (ADAMS Accession No. ML21114A002), withdrawing Interim Compensatory Measure B.1.a of NRC Order EA 02 026, Order for Interim Safeguards and Security Compensatory Measures, for Indian Point Nuclear Generating Unit 3 (IP3). The staff reviewed Entergys rescission request (ADAMS Accession No. ML19232A070) and determined that the licensee demonstrated good cause to withdraw the Order, considering the proper docketing of IP3 certifications for permanent cessation of operations and removal of fuel from the reactor vessel.

NRC Issues Indian Point Generating Unit License Amendments on License Transfers On May 28, 2021, Entergy Nuclear Operations, Inc. (ENOI) informed the NRC (ADAMS Accession No. ML21147A553) of the successful purchase and sale transaction closing of the Indian Point facilities to Holtec International (Holtec). On the same day, the staff issued the final conforming license amendments (ADAMS Accession No. ML21126A004) for Indian Point Unit Nos. 1, 2, and 3 in support of the transfer of the facility licenses from ENOI to Holtec Indian Point 2, LLC; Holtec Indian Point 3, LLC; and Holtec Decommissioning International, LLC.

NRC Issued Risk-Informed License Amendment to LaSalle County Station Using Alternative Seismic Approach On May 28, 2021, an amendment approving the adoption of Title 10 of the Code of Federal Regulations (10 CFR) 50.69 Risk-Informed Categorization and Treatment of Structure, Systems, and Components for Nuclear Power Reactors was issued for LaSalle Generating Station (ADAMS Accession No. ML21082A422). The amendment includes the staffs acceptance of a first-of-a-kind alternative seismic approach, termed the Tier 2 approach, for addressing seismic risk in the adoption of 10 CFR 50.69. The Tier 2 approach leverages risk insights from various sources, including seismic probabilistic risk assessments (SPRAs), to address seismic risk commensurate with the safety significance of the site-specific seismic hazard. The approach relies on focused plant walkdowns, quantitative assessments, and qualitative evaluations. The approach excludes plants that were required to develop SPRAs in response to the agencys post-Fukushima actions.

NRC Held Pre-Application Meeting on Licensing Higher Burnup Fuels On June 2, 2021, NRC staff held a pre-submittal meeting (ADAMS Accession No. ML21152A063) with Nuclear Energy Institute and the Electric Power Research Institute (EPRI) on EPRIs plans to develop and submit a topical report detailing a risk-informed approach to licensing higher burnup fuels. The meeting was conducted as a webinar open to public observers where EPRI representatives provided information about the approach including methods to account for known high-burnup effects such as fuel fragmentation, relocation, and dispersal. EPRI plans on submitting the topical report for review and approval for use in power plant licensing by the fourth quarter of 2022.

Items of Interest Week Ending JUNE 4, 2021 NRC Responded to Correspondence Regarding License Amendment for Demonstration Program On May 28, 2021, the NRC staff responded to an e-mail (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21090A056) from Terry J. Lodge, Counsel for the Ohio Nuclear Free Network, raising concerns about an amendment application submitted by American Centrifuge Operating, LLC, a subsidiary of Centrus Energy Corp., for approval of its high-assay low-enriched uranium (HALEU) Demonstration Program at its leased facility in Piketon, Ohio. The NRC staff response highlighted a set of frequently asked questions (FAQs) posted on the NRC website. These FAQs address topics regarding the HALEU Demonstration Program.

Industrial Radiographic Operations and Training: Notice of Interpretation; Request for Comment; 10 CFR Part 34 [PRM-34-6; NRC-2017-0022; NRC-2008-0173]

On June 1, 2021, the NRC published a notice in the Federal Register (86 FR 11436) issuing a notification of interpretation on industrial radiographic operations at temporary radiography jobsites and an Agreement State Compatibility Category change. The interpretation and Compatibility Category change are effective immediately with a 30-day post-promulgation comment period. The NRC is taking this action to respond to a petition for rulemaking from the Organization of Agreement States. This interpretation and Compatibility Category change are effective June 1, 2021. Comments are due by July 1, 2021.

Evidence-Building and Evaluation Policy Statement: Policy Statement; Issuance; 10 CFR Chapter I [NRC-2020-0262]

On June 3, 2021, the NRC published a notice in the Federal Register (86 FR 11637) issuing the Evidence-Building and Evaluation Policy Statement that describes the general standards that guide the NRCs evidence-building activities, consistent with the Foundations for Evidence-Based Policymaking Act of 2018. The policy statement is intended to provide agency personnel and stakeholders with a clear understanding of the expectations related to the NRCs standards for evidence-building activities, which includes analyses, research, assessments, and evaluations performed by the agency for programmatic, operational, regulatory, and policy decision making. These standards include rigor, relevance and utility, transparency, collaboration, independence and objectivity, and ethics. This policy statement is effective on June 3, 2021.
