Items of Interest Week Ending JANUARY 15, 2021 NRC Hosted Public Meeting with the Nuclear Energy Institute on NEI 20-07 On January 12, 2021, NRC staff held a public meeting with the Nuclear Energy Institute (NEI) and members of the public to discuss NEI 20-07, Draft B, Guidance for Addressing Software Common Cause Failure in High Safety-Significant Safety-Related Digital I&C Systems (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20245E561). During this meeting, NEI provided an overview of the guidance in NEI 20-07 (ADAMS Accession No. ML21006A006). The staff provided high-level comments on the presentation, and a member of the public provided a presentation regarding his concerns with NEI 20-07 (ADAMS Accession No. ML21008A094). The staff plans to review and provide comments on NEI 20-07 in February 2021 and hold the next public meeting to discuss these comments by March 2021.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Items of Interest Week Ending JANUARY 15, 2021 Non-Substantive Amendments to Adjudicatory Proceeding Requirements: Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 2 [NRC-2020-0033; RIN-3150-AK46]

On January 15, 2021, the NRC published a notice in the Federal Register (86 FR 4130) confirming the effective date of January 19, 2021, for the direct final rule that was published in the Federal Register on November 5, 2020 (85 FR 70435). This direct final rule revised and clarified the agencys rules of practice and procedure to reflect current Atomic Safety and Licensing Board Panel practice, Commission case law, and a decision of the Supreme Court of the United States and to enhance consistency within the NRCs regulations. The effective date of January 19, 2021, for the direct final rule published November 5, 2020, is confirmed.

Adjustment of Civil Penalties for Inflation for Fiscal Year 2021: Final Rule; 10 CFR Parts 2 and 13 [NRC-2018-0293; 3150-AK25]

On January 15, 2021, the NRC published a notice in the Federal Register (86 FR 3745) amending its regulations to adjust the maximum Civil Monetary Penalties it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The NRC is amending its regulations to adjust the maximum civil monetary penalty for a violation of the Atomic Energy Act of 1954, as amended, or any regulation or order issued under the Atomic Energy Act from $303,471 to $307,058 per violation, per day. Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum civil monetary penalty under the Program Fraud Civil Remedies Act from $11,665 to $11,803 for each false claim or statement. This final rule is effective on January 15, 2021.

List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM UMAX Canister Storage System, Certificate of Compliance No. 1040, Amendment No. 4; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2020-0179; RIN 3150-AK51]

On January 14, 2021, the NRC published a notice in the Federal Register (86 FR 2527) confirming the effective date of January 25, 2021, for the direct final rule that was published in the Federal Register on November 9, 2020 (85 FR 71223). This direct final rule amended the Holtec International HI-STORM UMAX Canister Storage System listing in the List of approved spent fuel storage casks to include Amendment No. 4 to Certificate of Compliance No. 1040.

Amendment No. 4 revises the certificate of compliance to update the technical specifications for radiation protection regarding the dose rate limit for the vertical ventilated module lid, update the technical specifications for the vent blockage limiting condition for operation, and add a Type 1 version of multi-purpose canister MPC-37. The effective date of January 25, 2021, for the direct final rule published November 9, 2020, is confirmed.

Office of Nuclear Security and Incident Response (NSIR)

Items of Interest Week Ending JANUARY 15, 2021 Staff Participated in Bilateral Emergency Management Meeting with Japan On January 14, 2021, NRC management and senior level staff participated in the Emergency Management Working Group, a cooperative between the US and Japanese governments to share policies and processes for emergency preparedness (EP) and response. NRC gave a presentation on the conduct of emergency EP exercises during the public health emergency (PHE) and an engaging discussion followed on the topic of training emergency responders during the PHE.

Staff Held Closed Stakeholder Meeting on 2021 Force-on-Force Inspections On January 14, 2021, NRC staff held a closed meeting with cleared stakeholders to discuss NRC-conducted Force-on-Force inspections in calendar year 2021. Staff presented overviews of COVID-19 related revisions to associated inspection procedures. Attendees at the meeting included representatives from power reactor licensees, the Nuclear Energy Institute, and the Union of Concerned Scientists.
