Items of Interest Week Ending DECEMBER 18, 2020 Exelon Submitted Letter of Intent to Pursue Digital I&C License Amendment for Limerick Generating Station in 2022 On December 11, 2020, Exelon Generation Company, LLC, submitted a letter stating its intent to submit a digital instrumentation and control (DI&C) modernization license amendment request for Limerick Generating Station, Units 1 and 2 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20346A026). The request will be submitted to the NRC in the third quarter of calendar year 2022, which is over one year later than the planned submittal date that was previously communicated (i.e., June 2021) to the NRC staff.

Exelon stated that the request will use the alternative review approach described in interim staff guidance DI&CISG-06, Revision 2 (ADAMS Accession No. ML18269A259). Exelon plans to replace the existing control logic hardware of the reactor protection system, nuclear steam supply shutoff system, and the emergency core cooling system. In addition, the redundant reactivity control system will be upgraded at Limerick and may be added to the scope of the license amendment request later depending on the licensees final evaluation of the planned changes.

Dominion Requested Extension for Response to Request for Additional Information Related to Surry Power Station Subsequent License Renewal On December 17, 2020, Virginia Electric and Power Company (Dominion) requested another 90 day extension (ADAMS Accession No. ML20352A377) to respond to the request for information concerning their Coastal Zone Management Act consistency determination from the state that is needed to support the environmental review of the Surry Power Station, Units 1 and 2, Subsequent License Renewal Application. The NRC cannot issue the renewed license without this consistency determination. The original request for information was issued February 5, 2020 (ADAMS Accession No. ML20029D838). The applicant and the Commonwealth of Virginia continue discussions on this matter.

NRC Hosted Meeting with Framatome to Discuss Increased Burnup Topical Report On December 17, 2020, the NRC held a virtual closed pre-submittal meeting (ADAMS Accession No. ML20309B016) with Framatome to discuss its Increased Burnup Topical Report.

During the closed meeting, Framatome representatives and NRC staff discussed Framatomes presentation on background information, NRC guidance, impact of burnup, fuel fragmentation relocation and dispersal, evaluation of methods, fuel designs and next steps for future interactions.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Items of Interest Week Ending DECEMBER 18, 2020 Transfer of Very Low-Level Waste to Exempt Persons for Disposal: Proposed Interpretive Rule; Withdrawal (10 CFR Chapter I; NRC-2020-0065)

On December 17, 2020, the NRC published a notice in the Federal Register (85 FR 81849) withdrawing a proposed interpretation of its low-level radioactive waste disposal regulations that would permit licensees to dispose of waste by transfer to persons who hold specific exemptions for the purpose of disposal by burial. The proposal was withdrawn based on the NRC staffs assessment that the proposed changes may not benefit the regulatory framework for the disposal of low-level radioactive waste. The proposed interpretive rule was withdrawn on December 17, 2020.

Fitness-for-Duty Program: Petitions for Rulemaking; Denial; 10 CFR Part 26 [PRM-26-3; NRC-2009-0482 and PRM-26-5; NRC-2010-0304]

On December 17, 2020, the NRC published a notice in the Federal Register (85 FR 81857) denying two petitions for rulemaking related to the fitness-for-duty program that were docketed as PRM-26-3, Professional Reactor Operator Society--Fitness-for-Duty Programs, and PRM-26-5, Nuclear Energy Institute--Fitness-for-Duty Programs, due to the discontinuation of the associated rulemaking. The dockets for PRM-26-3 and PRM-26-5 were closed on December 17, 2020.

Large Break Loss-of-Coolant Accident Redefinition: Petition for Rulemaking; Denial; 10 CFR Part 50 (NRC-2002-0018; PRM-50-75)

On December 17, 2020, the NRC published a notice in the Federal Register (85 FR 81848) denying a petition for rulemaking dated February 6, 2002, submitted by Anthony R. Pietrangelo on behalf of the Nuclear Energy Institute, due to the discontinuation of the associated rulemaking. The docket for PRM-50-75 was closed on December 17, 2020.

Erik Erb - Minimum Day Off Requirement for Security Officers: Petition for Rulemaking; Withdrawal by Petitioner (PRM-26-6; NRC-2010-0310)

On December 18, 2020, the NRC published a notice in the Federal Register (85 FR 82391) announcing the withdrawal, without prejudice to a future filing, of PRM-26-6, Minimum Day Off Requirement for Security Officers, submitted by Erik Erb and 91 co-signers (the petitioners) on August 17, 2010. The petitioners requested that the NRC amend its regulations to decrease the minimum days off requirement for security officers working 12-hour shifts from an average of 3 days per week to 2.5 or 2 days per week. This PRM was withdrawn by the petitioner on December 10, 2019.

Office of Nuclear Security and Incident Response (NSIR)

Items of Interest Week Ending December 18, 2020 Staff Participated in Interagency Webinar on Radiological Material Transportation On December 16, 2020 NRC staff participated in the fourth webinar on Radiant Response, a radiological transportation incident awareness virtual series, sponsored by the Department of Energy and the Federal Bureau of Investigation. The Radiant Response series poses scenarios that involve the theft/diversion of Category 1 or 2 radioactive materials for malicious purposes.

The exercises promote information sharing, discussion of response capabilities, problem resolution, and consequence management among Federal, State and local emergency response personnel. NRC staff presented information on the agency's mission and clarified roles and responsibilities.

Staff Held Closed Meeting with Stakeholders on Force-on-Force Inspections On December 15, 2020 NSIR staff hosted a closed meeting with industry representatives from the Nuclear Energy Institute, NextEra, Entergy and the Union of Concerned Scientists. The purpose of the meeting was to discuss disposition of external stakeholder comments on the staffs proposed force-on-force temporary instruction. Participants actively engaged with NSIR staff to ask clarifying questions and provide feedback on the staffs proposed instruction.
