Items of Interest Week Ending NOVEMBER 20, 2020 NextEra Submitted a Subsequent License Renewal Application for Point Beach Units 1 and 2 On November 16, 2020, the U.S. Nuclear Regulatory Commission (NRC) received a subsequent license renewal application from NextEra Energy for Point Beach Nuclear Plant, Units 1 and 2. The current renewed operating licenses for Point Beach, Units 1 and 2, expire on October 5, 2030, and March 8, 2033, respectively. The staff plans to complete its safety and environmental reviews within 18 months after the application is accepted for review. NRC Hosted Meeting with the National Organization of Test, Research and Training Reactors, Inc.

On November 19, 2020, NRC staff conducted a virtual public meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20307A166) with members of the National Organization of Test, Research and Training Reactors, Inc. (TRTR). The purpose of the public meeting was to discuss the proposed white paper being developed by members of TRTR providing guidance on compliance with the regulations in Title 10 of the Code of Federal Regulations (10 CFR) 50.59, Changes, tests and experiments, emphasizing aspects specific to research and test reactors.

NRC Hosted Public Meeting on Revision to Regulatory Guide 1.183 On November 19, 2020, the NRC held a Category 2 public meeting (ADAMS Accession No. ML20308A496) to discuss the process, schedule, and enhancements under consideration for a revision to Regulatory Guide 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors. This revision is expected, in part, to include guidance associated with licensing of advanced light water reactors and other industry initiatives, such as accident tolerant fuel, high-burnup, and increased enrichment.

Approximately 140 participants, including representatives from the Nuclear Energy Institute, Electric Power Research Institute, nuclear fuel vendors, and reactor licensees attended. The staff plans to hold another public meeting in early 2021 and will continue to seek stakeholder feedback prior to issuance of the draft regulatory guide for public comment in late 2021.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending NOVEMBER 20, 2020 NMSS Staff Approved Implementation of Cyber System for Piketon, Ohio Facility On November 17, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff, in coordination with the U.S. Department of Energy (DOE), approved the implementation of Centrus Energy Corp./American Centrifuge Operatings (ACOs) cyber system at ACOs Piketon facility for the processing of classified information up to and including Secret Restricted Data for three years.

The approval authorized ACO to begin using its distributed control system for the 16-centrifuge cascade which is to be installed in the Piketon, Ohio facility under the High Assay Low Enriched Uranium Demonstration Program. Based on the NRCs October 30, 2020, approval of ACOs security plans and the results of the operational readiness review performed by the staff, in coordination with DOE, it was determined that ACOs cyber system provides adequate security.

NMSS and Regional Staff Held a Public Meeting on COVID-19 Related Regulatory Requests On November 17, 2020, NMSS and Regional staff held a public meeting to discuss available regulatory relief for medical, industrial, and academic licensees during the ongoing COVID-19 public health emergency and to engage stakeholders to determine whether there is need for additional regulatory relief. Approximately 174 licensees, Agreement State representatives, and other stakeholders joined the WebEx meeting. The staff answered questions regarding the timing of exemption requests, available relief for closed facilities, how inspections are handled when facilities are limiting site access, what COVID-prevention measures NRC inspection staff are taking during on-site inspections, whether remote inspections are eventually followed up with in-person inspections, and how requests for remote training for authorized users are being handled.

NMSS Staff Held Public Meeting on the Technology Inclusive Advanced Nuclear Reactor Rulemaking On November 18, 2020, the staff held a public webinar to discuss preliminary proposed safety criteria rule language (subpart B) for the technology inclusive Part 53 advanced nuclear reactor rulemaking. More than 100 stakeholders attended the meeting, including representatives from the Nuclear Energy Institute, United States Nuclear Industry Council, and advanced reactor developers. Stakeholders provided varying perspectives on the preliminary rule language, but in general were supportive. The next steps will be to release preliminary proposed rule language related to design (subpart C) and sitting (subpart D) criteria to support a public meeting on January 7, 2021.

NMSS Staff Participated in American Nuclear Society Meeting During the week of November 16, 2020, NMSS staff participated remotely in two expert panels at the American Nuclear Society Winter Meeting. The staff delivered presentations on the NRCs decommissioning staff development, training, and qualification programs and the Nuclear Energy Innovation and Modernization Act Section 108 Final Report on Best Practices for Local Community Advisory Boards.

NMSS Staff Participated in Public Meeting on Hanford Waste On November 19, 2020, NMSS staff participated in a DOE public meeting to discuss its Draft Waste Incidental to Reprocessing Evaluation regarding the Vitrified Low Activity Waste Disposed Onsite at the Hanford Site. The purpose of the meeting was for NRC to provide clarification on the Requests for Additional Information (RAIs) that were issued to DOE on November 6. After providing a general overview of the RAIs, the meeting format enabled the public to ask questions directly to the NRC staff about NRCs review process and the development of the RAIs. This format has been effective in enhancing public confidence in the review process and highlighting NRCs independent review.

Office of Nuclear Security and Incident Response (NSIR)

Items of Interest Week Ending NOVEMBER 20, 2020 Staff Participated in the Annual Meeting of the Centrifuge Collaboration Security Working Group On November 12, 2020, staff from NSIR and the Office of International Programs (OIP) participated in a WebEx call of the annual meeting of the Centrifuge Collaboration Security Working Group. The working group is composed of five countries, the United Kingdom, Germany, The Netherlands, France and the United States. These countries are party to the Treaty of Paris, which provides a framework for the establishment of procedures for the handling of classified information regarding the operation of uranium installations in the U.S. and abroad using European centrifuge enrichment technology. The next meeting will be held in the United States in late summer 2021 (pending the status of the COVID-19 pandemic in the U.S and abroad).

Staff Hosted Public Meeting on Cyber Security Program Guidance On November 17 and 18, NSIR hosted a Category 2 public meeting to discuss implementation of risk-informed enhancements to the cyber security program, as described in the Nuclear Energy Institute (NEI) white papers Changes to NEI 10-04 and NEI 13-10 Guidance for Identifying and Protecting Digital Assets Associated with the Balance of Plant and Changes to NEI 10-04 and NEI 13-10 Guidance for Identifying and Protecting Digital Assets Associated with Safety-Related and Important-to-Safety Functions. The meeting was attended by nearly 70 participants from the U.S. Nuclear Regulatory Commission (NRC) staff, industry and the public.

The meeting provided an opportunity for industry to present the white papers using examples for identifying critical digital assets associated with balance of plant and safety-related and important-to-safety functions. Additionally, the meeting provided the NRC, industry, and the public the opportunity to provide feedback on industrys proposed implementation of the guidance in the white papers.
