ME1499)," dated July 2, 2009 In Reference 1, Exelon Generation Company, LLC (EGC) requested an amendment to Facility Operating License No. NPF-62 for Clinton Power Station (CPS), Unit 1 . The proposed change was submitted to eliminate the potential for an unnecessary plant transient caused by a main steam line (MSL) isolation that is not credited in any CPS design basis or transient analysis . In Reference 2, EGC requested that the proposed change be evaluated and approved by the NRC on an emergency basis in accordance with 10 CFR 50.91(a)(5) . This request was made in response to elevated ambient air temperatures and equipment issues in the vicinity of the Turbine Building temperature instruments that were causing the instruments' MSL isolation

While the NRC initially agreed to evaluate the proposed change on an emergency basis, ambient air temperatures did not increase as expected . In Reference 3, the NRC indicated that amendment request would no longer be processed as an emergency in accordance with 10 CFR 50 .91(a)(5) .

After internal discussions, EGC has determined that it no longer desires to pursue this amendment. Therefore, EGC is withdrawing the license amendment requested in Reference 1 .

EGC appreciates the NRC staffs' initial accommodation of our request to process this amendment on an emergency basis.
