Ladies and Gentlemen:

In Reference 1, Duke Energy Carolinas, LLC (Duke Energy) requested U.S. Nuclear Regulatory Commission (NRC) approval for an exemption to the requirements of 10 CFR 72.212(a)(2),

U.S. Nuclear Regulatory Commission RA-22-0149 Page 2 10 CFR 72.212(b)(3), 10 CFR 72.212(b)(5)(i), 10 CFR 72.212(b)(11) and 10 CFR 72.214 for 74 MAGNASTOR Vertical Concrete Casks (VCCs). NAC International (NAC), the Certificate of Compliance (CoC) holder for the MAGNASTOR storage system, recently brought to the attention of Duke Energy a Nuclear Regulatory Commission (NRC) identified noncompliance issue with the fabrication of VCCs delivered to Duke Energy.

In Reference 2, NAC submitted a License Amendment Request for the NAC International MAGNASTOR Cask System Amendment No. 12. A supplement to Amendment No. 12, was subsequently submitted to the NRC by NAC (Reference 3). In Reference 4, the NRC requested additional information (RAI) from NAC to complete its review. NAC provided RAI responses to the NRC in Reference 5, which included updates to the MAGNASTOR Technical Specifications (TS). This letter confirms that Duke Energy has reviewed the responses in Reference 5 and confirms the concrete casks are fabricated in accordance with the updated TS provided by NAC.

Duke Energy is aligned with the NAC RAI responses and there are no impacts to the exemption request conclusions provided in Reference 1.
