Entergy Nuclear Operations, Inc. letter to U.S. Nuclear Regulatory Commission, Certifications of Permanent Cessation of Power Operations and Permanent Removal of Fuel from the Reactor Vessel, (ADAMS Accession No. ML22164A067), dated June 13, 2022.

In this letter Entergy Nuclear Operations, Inc. (Entergy) hereby notifies the U.S. Nuclear Regulatory Commission (NRC) that the Emergency Response Data System (EROS) data link between Palisades Nuclear Plant (PNP) and the NRC has been terminated, as it is no longer required by Title 1O of the Code of Federal Regulations, Part 50 (1 O CFR 50) Appendix E, Emergency Planning and Preparedness for Production and Utilization Facilities, Section Vl.2.

10 CFR 50 Appendix E Section VI, Emergency Response Data System, establishes that a nuclear power reactor licensee is required to have a real-time electronic data link from the licensee's onsite computer system to the NRC Operations Center that provides for the automated transmission of a limited data set of selected parameters. However, 10 CFR 50 Appendix E Section Vl.2 specifically exempts those nuclear power facilities that have permanently or indefinitely shutdown from the requirement to maintain the EROS data link with the NRC. PNP meets this exemption criteria by the referenced letter, which in accordance with 10 CFR 50.82, Termination of license, subparagraphs 50.82(a)(1)(i) and (ii), Entergy certified to the NRC that it had permanently ceased power operations at PNP and permanently removed fuel from the PNP reactor vessel.

Based on the permanent cessation of power operations at PNP and permanent removal of fuel from the PNP reactor, Entergy is exempt from the requirements to have an EROS data link from PNP to the NRC in accordance with 10 CFR 50 Appendix E, Section Vl.2 and has terminated the EROS transmission link to the NRC.
