June 24, 2022 ALL AGREEMENT STATES, CONNECTICUT, AND INDIANA, NOTIFICATION OF FINAL RULE - FEE RECOVERY FISCAL YEAR 2022 (STC-22-042)
Purpose:
To inform the Agreement States that the U.S. Nuclear Regulatory Commission (NRC) has published a final rule to modify Title 10 of the Code of Federal Regulations (10 CFR)
Parts 170 and 171 regarding the licensing, inspection, and annual fees to recover, to the maximum extent practicable, approximately 100 percent of its Fiscal Year (FY) 2022 budget authority, less the budget authority for excluded activities.
Background:
These amendments are necessary to implement the Nuclear Energy Innovation and Modernization Act, which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee recovery requirement. Please see the FY 2022 Final Fee Rule Work Papers (Agencywide Documents Access and Management System Accession No. ML22136A015) for the detailed financial analysis used to determine the final fees. The final rule was published in the Federal Register (FR) on June 22, 2022 (87 FR 37197) and becomes effective on August 22, 2022.
Discussion: The NRC is amending the flat application fees it charges to licensees to reflect an increase in the professional hourly rate to $290. Changes in the FY 2022 materials fees can be found in pages 37215-37220 of the Schedule of Materials Fees. The final rule is available on the Federal rulemaking Portal (http://www.Regulations.gov) under Docket ID: NRC-2020-0031, or at https://www.nrc.gov/about-nrc/regulatory/licensing/fees.html.
