HOLTEC INTERNATIONALS APPLICATION FOR SPECIFIC INDEPENDENT SPENT FUEL STORAGE INSTALLATION LICENSE FOR THE HI-STORE CONSOLIDATED INTERIM STORAGE FACILITY FOR SPENT NUCLEAR FUEL - REVISED REVIEW SCHEDULE

Dear Kimberly Manzione:

By letter dated March 30, 2017 (Agencywide Documents Access and Management System

{ADAMS} Accession No. ML17115A431), as supplemented, Holtec International (Holtec) submitted to the U.S. Nuclear Regulatory Commission (NRC) an application for a specific independent spent fuel storage installation license to construct and operate the HI-STORE Consolidated Interim Storage (CIS) Facility, in Lea County, New Mexico, in accordance with the requirements of Part 72 of Title 10 of the Code of Federal Regulations (10 CFR Part 72),

Licensing Requirements for the Independent Storage of Spent Nuclear Fuel, High-Level Radioactive Waste and Reactor-Related Greater than Class C Waste. The license application seeks NRC approval to store up to 8,680 metric tons of commercial spent nuclear fuel in the HI-STORM UMAX Canister Storage System for a 40-year license term.

On November 19, 2021, the staff informed Holtec (ML21322A219) that its responses to NRCs second request for additional information (RAI) did not provide sufficient information to complete its review and that it would issue a third request for additional information. In this letter, the staff also informed you that it would not complete its safety and security review and publish a final safety evaluation report (SER) by its previously scheduled date of January 2022. On March 23, 2022, the staff issued its third RAI (ML22062B669) in connection with the safety review of the application. On April 15, 2022, Holtec submitted its responses to the staffs third RAI (ML22108A114).

The staff has reviewed your responses to the third RAI and determined that the responses have not sufficiently addressed the staffs third RAIs related to the evaluation of external hazards, the evaluation of the proposed canister transfer building, and the evaluation of the off-site dose estimate. NRC staff will be scheduling additional clarification calls or public meetings with you over the following weeks to discuss the areas where further clarification and/or supplementation is needed for the NRC to complete its review of your application.

K. Manzione 2 For the environmental review, the staff expects to publish the final environmental impact statement (EIS) in July 2022. This date for the publication of the final EIS is not contingent on the receipt of additional supplementation to your responses to the third RAIs.

For the safety review, the staff has determined that, if Holtec can promptly address the remaining areas of clarification and/or supplementation with high-quality and fully responsive information by June 2022, the NRC will issue the final SER (in conjunction with its final licensing decision) by January 2023. If additional RAIs are necessary, the staff will appropriately consider whether to further delay its schedule or to suspend its review.
