Reference 1: Response to Request for Additional Information (March 30, 2022)

In response to an email request from the Nuclear Regulatory Commission (NRC) staff on April 14, 2022 for additional information, EnergySolutions, LLC (EnergySolutions) hereby submits the following information regarding the above-referenced Application for NRC approval of the indirect transfer of control of the subject licenses (Accession No. ML21344A114, referred to as the EnergySolutions indirect license transfer).

Consistent with EnergySolutions response in Reference 1 to the NRCs request for additional information, this letter confirms that EnergySolutions accepts, with respect to the La Crosse Boiling Water Reactor (LACBWR) licenses, that the order approving the EnergySolutions indirect license transfer should include approval of the transfer of control of the LACBWR licenses, subject to a condition that would provide as follows:

If EnergySolutions does not indirectly hold Possession Only License No. DPR-45 for LACBWR, and the general license for the LACBWR ISFSI, at the time of the closing of the proposed indirect license transfer, then the LACBWR licenses shall not be transferred as part of the indirect license transfer.

Currently EnergySolutions wholly owned subsidiary LaCrosseSolutions, LLC is still engaged in the final stages of decommissioning and site restoration at the LACBWR site. These activities are not expected to be completed prior to the closing of the EnergySolutions indirect license transfer.
