NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket / License Nos.: 50-317; DPR-53 Calvert Cliffs Nuclear Power Plant _50-318; DPR-69 As a result of the inspection conducted on April 4 - May 15,1989, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the follow-ing violation was identified:

I 10 CFR 50.59(a)(1) states, in part, that the licensee may make changes to systems and procedures described in the Final Safety Analysis Report (FSAR) provided the changes do not involve an unreviewed safety question.

10 CFR 50.59(b)(1) requires, in part, that records of such changes be maintained and must include a written safety evaluation which provides the bases for the determination that the change does not involve an unreviewed' safety question.

In addition, Technical Specification (TS) 6.5.1.6 requires, in part, that all proposed changes to procedures that affect nuclear safety shall be reviewed by the Plant On Site Safety Review Committee (POSRC).

Contrary to the above, on May 9,1989, a change of intent to Operating Instruction 29, " Salt Water System," was made to allow throttling of the salt water system discharge valves without a written safety evaluation in accordance with 10 CFR 50.59 to determine if an unreviewed safety question existed or without a review and approval by POSRC.

! This is a Severity Level IV Violation (Supplement I) applicable to DPR 53 and 69.

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas and Electric Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
