F0WER AGENCY NON191006 (Shearon Harris Nuclear Plant) March 19, 1986 ORDER (Concerning Emergency Planning Exercise Contentions)

The Applicants, supported by the NRC Staff and FEMA, have moved for summary disposition of Eddleman Contentions EPX-2 and -8. Mr. Eddleman has filed an opposition and supplemental opposition to those motions.

Also pending before the Board is a motion from Mr. Eddleman to reconsider our earlier ruling rejecting his proposed Contention EPX-5.

Consistent with our past practice, the Board is issuing its rulings on these motions, without reasons, in order to facilitate planning by the parties. The motions for summary disposition of Contentions EPX-2 and -8 are granted; the motion to reconsider rejection of EPX-5 is denied. The reasons for these rulings will be included in a Final Initial Decision on the siren and drug use contentions to be issued in the near future.
