in accordance with Part 76 to Title 10 of the Code of Federal Regulations enclosed are the initial certificates of compliance for the U.S. Enrichment Corporation to operate the two gaseous diffusion plants located in Paducah, Kentucky, and Piketon, Ohio. ,
1 The initial certificates are issued for an effective period of approximately 2 years, with expiration dates of December 31,1998. This is consistent with the provision in Public Law 104-134, the USEC Privatization Act, which amended the Atomic Energy Act by replacing the requirement for an annual application for a Certificate of Compliance with a requirement for an application to be filed " periodically, as determined by the Commission, but not less than every five years." Therefore, the certificates contain an exemption from the requirements in 10 CFR Part 76, il 76.31 and 76.36, to submit an annual application for certificate renewalin 1997. USEC will be required to file an application for renewal of the Certificates of Compliance by April 15,1998.
I NRC intends to assume regulatory jurisdiction over the plants from the U.S. Department of Energy on March 3,1997. Questions msy be directed to Merri Horn or Carl Sawyer at (301) 415-7192.
