NRC STAFF NOTICE OF ISSUANCE OF AMENDMENT OF ORDER AND MOTION TO CONFORM PROPOSED TECHNICAL SPECIFICATIONS IN ACCCRDANCE THEREWITH On August 8, 1985, the Director, Officer of Nuclear Reactor Regula-tion (Director) issued the attached Amendment of Order pursuant to his authority under 10 C.F.R. 9 2.717(b). This amendment will r:odify the license requirements imposed by an Order of the Director dated February 11, 1550, by modifying the proposed Technical Specifications by

, (1).modificaticr.s to existing limiting conditions for operation that were proposed to r. ore correctly stcte what systems or equipment are necessary based on the present status of TMI-2, (2) the addition of r.ew limiting cer.citiens fcr cperation proposed to more correctly reflect v. hat systems

. or equipment are necessary based on the present status of TMI-2 and (2) mooifications to the bases that reflect corresponding changes in

'iimiting conditions for operation. This Amencment of Order will be ef-fective on September 23, 1985.

2-Also concurrently issued on August 8, 1985 were (1) an exemption from the recuirements of 10 C.F.R. 50, Appendix A, General Design Crite-ria 34 with respect to the residual heat removel system, and (2) an ex-erption from the requirements of 10 C.F.R. 50, Appendix A, General Design Criteria 37 with respect to the testing of the emergency core cooling system.

The Staff's Safety Evaluation Report, revised proposed Technical Specifications, Exemptions, Environmental Assessment and Notice of Find-ing of No Significant Impact are also attached.

Fursuant to an Order of the Commission, dated May 12, 1980, this Licensing Board has been designated to conduct the proceeding with re-spect to the proposed formal license amer.dment incorporating the Techni-cal Specifications proposed in the February 11, 1980 Order. In order to conforn the proposed Technical Specifications with the actions taken by the Director in the attached Amendment.of Order, the NRC staff hereby moves that the proposed Technical Specifications be formally modified to conform to the Amendment of Order subject to the authority which 10 C.F.R. s 2.717(b) explicitly preserves in the presiding officer for purposes of this proceeding. Formal amendment of the license will, of course, await the cutcome of the prospective hearinc.
