Executive Vice President Gentlemen:

Recently we were informed by FEMA Region IX of a change in FEMA's position on a matter related to the prompt public notification system (Alert Notification System or ANS) required by IV.D.3 of Appendix E, 10 CFR Part 50.

Specifically, FEMA is altering their position with respect to the requirement for a utility-conducted telephone survey (statistical sampling) of the public in conjunction with the annual test of the ANS. The following is the changed FEMA policy statement.

"NUREG-0654/ FEMA-REP-1, Rev. 1, Appendix 3, has a requirement that statistical sampling be performed annually. In consideration of the positive results received from the 25 surveys conducted to date, we have determined that future annual surveys following the initial approval (emphasis added) of an ANS are unnecessary if the system is properly maintained. The data available from these surveys strongly indicate that properly designed siren systems are adequate to provide an alert signal and that unless a significant change is made to the system or there is a drastic change in the demographics of the area after the FEMA approval, future surveys on ANS consisting of sirens should not be necessary. Our intent is to redirect the time and effort of State and local governments and licensees that would be expended on the survey to creating a solid routine siren testing and maintenance program to ensure that siren operability is maintained above 90%. Each ANS is subject to an engineering analysis pursuant to NUREG-0654/ FEMA-REP-1, Rev. 1, and FEMA-43 only once unless a significant change, as specified in 44 CFR 350.14, is made to the ANS. FEMA Regional offices will be responsible for reviewing such changes to the ANS after the initial FEMA approval.

The nuclear power plant sites that have already received an ANS approval will be excepted from the annual survey requirement in NUREG-0654/ FEMA-REP-1, Rev. 1, Appendix 3. This exception will remain in effect untill GM-AN-1, which will contain the outyear requirements, has been finalized and formally published as policy."
