REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE

Dear Ms. Johnson:

i By letter from Commonwealth Edison Company (Comed) dated December 2,1996, and General Electric Company's (GE) affidavit executed by David J. Robare, dated April 22, 1996, you submitted a proprietary document entitled, " Safety Review for LaSalle County Station Units 1 and 2 Safety / Relief Valves Reduction and Setpoint Tolerance Relaxation Analyses," GE-NE-B13-01760, Revision 2, dated February 1996 and requested that it be wit'hheld from public disclosure pursuant to 10 CFR 2.790. A non-proprietary version was also included in the submittal.

GE stated that the information should be considered exempt from mandatory public disclosure for the following reasons:

"(4)a Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by General Electric's competitors without license from General Electric constitutes a competitive economic advantage over other companies.

(4)b Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product; (8) The information identified in paragraph (2), above, [ Safety Review for LaSalle County Station Units 1 and 2 Safety / Relief Valves Reduction and Setpoint Tolerance Relaxation Analyses," GE-NE-B13-01760, Revision 2, dated February 1996] is classified as proprietary because it /

contains detailed results of analytical models, methods and P processes, including computer codes, which GE has developed, obtained NRC approval of, and applied to perform evaluations (Fo/

of the loss-of-coolant accident for the BWR.

The development and approval of the BWR loss-of-coolant accident analysis computer codes used in this analysis was achieved at a significant cost, on the order of several million collars, to GE.

We hav; reviewed your submittal and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of GE's statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

Therefore, we have determined that the documents entitled, " Safety Review for LaSalle County Station Units 1 and 2 Safety / Relief Valves Reduction and Setpoint Tolerance Relaxation Analyses," GE-NE-B13-01760, Revision 2, dated February 1996, marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document. If the need arises, we may send copies of this i_nformation to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling propr,ietary information.

If the basis for withhol' ding this information from public inspection should change in_ the future such'that.the information could then be made available for public inspection, you ihould promptly notify the NRC. You should also understa.nd c thatithe NRC may have-cause to review this determination in the future, for gxample, if the . scope of a Freedom of Information Act request includesyoup-information. In .all . review situations, . if the NRC needs additional information. from you or makes a determination adverse to the above, you will be" notified in advance of any public disclosure.
