Limerick Generating Station, Units 1 and 2 National Pollutant Discharge Elimination System Permit Temporary Discharge of Waste Water Gentlemen:

This letter is being submitted to notify the NRC of PECO Energy's plans to discharge approximately 300,000 gallons of waste water from the holding pond at Umerick Generating Station (LGS), and release it to the Schuylkill River. This release is classified as a Temporary Discharge and is not considered a change / revision to the approved LGS National Pollutant Discharge Elimination System (NPDES) Permit (Permit No. PA0051926).

The LGS, Units 1 and 2, Environmental Protection Plan (EPP) Section 3.2, indicates that the NRC shall be notified of any proposed changes to the effective NPDES permit at the same time the request is submitted to the permitting agency. Since this Temporary Discharge does not constitute a change to the approved LGS NPDES permit, prior notification of this waste water release was not required. However, PECO Energy considers it appropriate to provide this i notification in accordance with the LGS, Units 1 and 2, EPP Section 3.2, which also stipulates that the NRC shall be notified within 30 days following the date of approval of a change to the NPDES permit.

By letter dated December 19,1996, the Pennsylvania Department of Environmental Protection (PA DEP) approved PECO Energy's request for this Temporary Discharge of waste water from the LGS holding pond to the Schuylkill River. Therefore, this letter serves as notification that the PA DEP has approved our request.

Dear Mr. Matty:

This is in reply to your December 17,1996 letter requesting approval for a temporary discharge from the holding pond at PECO's Limerick Generating Station.

The discharge of approximately 300,000 gallons will be through Monitoring Point 201, and will ultimately discharge to the Schuylkill River via Outfall 001.

We hereby approve your request to discharge, subject to the following conditions:

1. Weekly sampling of Monitoring Point 201, as required in PECO's NPDES Permit No. PA0051926, shall be taken during the temporary discharge as outlined in your December 17,1996 letter.

2. Monitoring Point 201 shall be sampled at the start of the ternporary discharge and at 2-hour intervals during the duration of the temporary discharge, and analyzed for fecal coliforms using EPA approved test methods. These sample results shall not be greater than 200/100 ml of fecal coliform organisms as a geometric average value, nor greater than 1,000/100 ml of fecal coliform organisms in more than 10% of the samples tested.
3. All monitoring results shall be submitted with the December 1996 Discharge Monitoring  ;

Report, required under NPDES Permit No. PA0051926. I l

4. If the temporary discharge by this approval does not comply with all conditions outlined herein, the discharge constitutes an unpermitted discharge and is subject to all penalty provisions under the Clean Streams Law.

Verbal approval for this temporary discharge was given to you on December 17,1996, by Mr. Steve O'Neil of my staff.

This letter does not waive, either expressly or by implication, the power of authority of the Commonwealth of Pennsylvania to prosecute for any and all violations of law arising prior to or after the issuance of this approval or the conditions upon which the approval is based. This letter shall not be construed so as to waive or impair any rights of the Department of Environmental Protection, heretofore or hereafter existing.
