l The purpose of this letter is for Connecticut Yankee Atomic Power Company  !

(CYAPCO) to discontinue the payment of annual fees as outlined in 10CFR171.15 for

the Haddam Neck Plant (HNP) in a letter dated December 5,1996,W CYAPCO infcrmed the NRC that the Board of Directors of CYAPCO had decided to permanently cease operations at the HNP and that the fuel had been permanently removed from the reactor. In accordance with 10CFR50.82(a)(2), the certifications in this letter modified the HNP license to permanently withdraw CYAPCO's authority to operate. As a result, CYAPCO is only authorized to possess special nuclear material. i in conjunction with the HNP license modification, CYAPCO has reviewed the annual fee requirements of 10CFR171 for applicability. CYAPCO has concluded that 10CFR171 l no longer applies to the HNP. Specifically,10CFR171.3, " Scope," states the following

"The regulations in this part apply to any person holding an operating license for a power reactor, . . . ."

10CFR171.5, " Definitions," further states:  ;

" Operating license means having a license issued pursuant to 9 50.57 of this chapter. It does not include licenses that only authorize possession of special nuclear material after the Commission has received a request from the licensee to amend its licensee to permanently withdraw its authority to operate or the g300 ?g Commission has permanently revoked such authority."

l Based on the exclusion cited in 10CFR171.5, CYAPCO will discontinue payment of annual fees as outlined in 10CFR171.15 beginning on January 1,1997. CYAPCO will continue to pay the fees as outlined in 10CFR170 for regulatory and licensing services.
