LICENSEE'S RESPONSE TO STAFF'S MOTION TO CONFORM PROPOSED TECHNICAL SPECIFICATIONS IN ACCORDANCE WITH SEPTEMBER 20, 1985 CORRECTION TO AMENDMENT OF ORDER On August 8, 1985, the Director of the NRC Office of Nu-clear Reactor Regulation ("NRR") issued an " Amendment of Order," revising the Proposed Technical Specifications which are the subject of the proceeding. By the August 28, 1985 "NRC Staff Notice of Issuance of Amendment of Order and Motion To Conform Proposed Technical Specifications In Accordance There-with," the Staff moved that the proposed Technical Specifica-tions be formally modified in accordance with the August 8

" Amendment of Order." The Board granted the Staff's August 28 motion. See " Order (Granting Staff's Motion of August 28, 1958)" (September 24, 1985).

In the interim, on September 20, 1985, the Director of NRR has issued a " Correction To Amendment of Order," which modifies the proposed Technical Specifications revised by the Director's August 8 " Amendment of Order" to correct editorial and typo-graphical errors, but which does not affect the substance of.

the " Amendment of Order" or the supporting safety evaluation.

By the September 23, 1985 "NRC Staff Notice of Issuance of Cor-rection To Amendment of Order and Motion To Conform Proposed

' Technical Specifications In Accordance Therewith," the Staff 1

has moved that the proposed Technical Specifications be formal-ly modified to conform to the August 8, 1985 " Amendment of Order" as revised by the September 20, 1985 " Correction To Amendment of Order," subject to the authority which 10 C.F.R. 5 2.717(b) reserves to the presiding officer in this proceed-ing.

As Licensee understands the Staff's motion, it is simply a request by the Staff that the Board issue an order notifying all parties that the proposed Technical Specifications under consideration in the prospective hearing requested in this pro-ceeding are revised in accordance uith the August 8, 1985

" Amendment of Order" as corrected by the September 20, 1985

" Correction To Amendment of Order." The formal license amend-ment incorporating the proposed Technical Specifications, as corrected and amended, would await the outcome of the prospec-tive hearing. With this understanding, Licensee does not op-pose the motion.
