! As a result of an inspection conducted September 30,1996 through October 4,1996, the )

l following violation of NRC requirements was identified. In accordance with the NRC j Enforcement Policy (60 FR 34381; June 30,1995), the violation is listed below:

i Technical Specifications, Sectico 4.8.A.1 states, "The radioactivity content of each batch of radioactive liquid waste to be discharged shall be determined prior to release

[ by sampling and analysis in accordance with Table 4.8-1." Table 4.8-1, requires, in l' part, that monthly composites be analyzed for tritium and gross alpha, and quarterly composites be analyzed for strontium-89, strontium-90, and iron-55.

Contrary to the above, monthly and quarterly composites from each batch of liquid l released from the neutralizer sump were not always analyzed according to Table

! 4.81 until July 12,1994. Prior to that time, monthly composites for tritium and l gross alpha radioactivity and quarterly composites for strontium-89, strontium-90, I and iron-55 were analyzed only if the batch sample indicated the presence of gamma-emitting radionuclides.

This is a Severity Level IV violation (Supplement IV).

i The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence is adequately addressed on the docket in Licensee Event Reports (LERs) 96-10, dated November 4,1996, LER 95-07, dated September 5,1995 and Section 3.4 of NRC Inspection Report 95-21 for IFl 95-21-01. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility which is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

LER 96-10 identified the root cause of this violation as a programmatic deficiency and included immediate and planned corrective actions. Therefore, BECo is not required to I respond to this Notice unless you choose to do so or disagree with the violation.
