Dear Ms. Johnson:

On February 13 1991, the NRC issued Amendment No. 128 to Facility Operatin j LicenseNo.DPk-29andAmendmentNo.123toFacility0 i DPR-30 for the Quad Cities Nuclear Power s 1Station, Ur.it,,erating Licel and 2, respectively, to recapture the construction period of the plants. These amendments changed i

the expiration date for the respective plant license to 40 years from the date j~ of issuance of the full power license (issued on December 14,1972), thereby i making each license expiration date December 14, 2012. The 40 year time frame was established in accordance with 10 CFR 50.51.

This letter requested to change each license expiration date from 40 years i from the date of issuance of the full power operatin i the date of the initial low power operating license,g because license tothe 40time years from of 40

years from the date of issuance of the full power operating license was used.

l In 10 CFR 50.51 it states "Each license will be issued for a fixed period of

! time to be specified in tfie license but in no case to exceed 40 years from j date of issuance." The licenses of Quad Cities, Units 1 and 2, presently meet  ;

4 this criteria, as the regulations do not specify for which operating license  !

3 (initial low power or full power) the 40 years is referenced. In the past, i

the expiration date of licenses to nuclear power station facilities have been '

i granted either from the initial low power or the full power operating license.

The NRC requests that Comed advise the staff as to whether it wants to proceed

with the change in the license expiration date for both units or whether Comed j wishes to withdraw the request.
