License No. DPR-59 Docket No. 50-333 Subiect: IMPOSITION OF CIVIL PENALTIES - $300,000 By EN 92-71 dated September 14, 1992, the Commission was notified of the intent of OE to issue a Notice of. Violation and Proposed Imposition of Civil Penalties (Notice) in the amounc of-$500,000 to New York Power Authority (FitzPatrick).- The action was based on violations in five areas: (1) Inadequate post-modification testing of Reactor Protection System relays, (2) inadequate corrective actions, (3) fire protection program implementation, (4) 10 CFR Part 50, Appendix R, requirements, and (5) the submittal to the NRC of inaccurate information.

The licensee responded to the Notice in a letter-dated October 15, 1992. After careful consideratien of the licensee's l response, the staff has concluded that the violations ~did occur.

$300,000 has been issued today. Under the terms of the Order, +

the licensee may within 30 days of the date of the' Order', pay the civil penalties or request a hearing.
