1. The Board asked for us to quote possible authority r eocath pipelines involved in our contention.. To clarify the., situs ( paJ,pgelati,on to the ARCO pipeline we enclose an affidavit of Vincent S.Boyer,'d'Ekg$)%) with agreement of 10/27/82 attached, In this agree'nent between PEco and ARCO the former relinquished its right to require relocation of the pipeline at the latter's expense at any time PECo should choose,in return for AR g y Q sfug the line for propane shipments. We now petition the Board as part of its ruling,Tor'e-quire PEco to revoke this agreement since it was entered into during the litiga-tion 'of our contention and is,therefore, illegal and amounts to an attempt to cir-cumvent NRC's ' authority to require reloc a tion of the pipeline, for the sake of atfe

- operation of the plant and the protection of the public health and safety. Along with the revoking of this agreement we peti. tion the Board to require PEco to relocate the ARCO pipeline before granting an operating license.(Brief 11/23/84p.lc

2. We also petition the Bo ard to reverse LH's ' decision on our contention, LBP-84-31 and to issue the six specific orders which we listed in our 5/2/84 Conclusions & Pindings p.8.
3. The Board questioned the NRC Staff Counsel about the status of the vulner-ability of the Spray Pond and were told that tne ability for safe shutdown in ro-lation to coolig from this source was settled. This is not true. (Br.11/23/84 B-86 to 89 , p. 5.) NRC low power license NFF-27 carried Ultimate Heat Sink as an exemption with reservations to be satisfied " prior to exceeding 5 % rated power 6

( Lic.10/26/84 p. 7 (18) and p. 8 ,D. ) NRC stift1 carries the tornado and rail-road explosion threats to the Spray Pond operatiin as unresolved. The Board should authorize no license until this safety fe ture a is completely resolved (See enclosed

2. Table 2.2-2, Figure 2.2-4 and Section 9.5.4.3 (specifically page 9 5-34) of the Final Safety Analysis Report for the Limerick Generating Station were prepared under my direction and supervision.. This Table and Figure deal with the pipelines at the Limerick site and .this Section dis-cusses the exposure of the diesel oil storage tanks and piping of the Lim-erick facility to sources of ignition. -
3. The statements and matters therein are true and correct to the best of my knowledge, information and belief.
4. Attached hereto is a true and correct copy of an agreement
  • between Philadelphia Electric Company and Arco Pipeline Company dated October 27, 1982 relating to the use of the Arco pipeline which crosses the Limerick site.

in the City of Independence, State of Kansas, hereinafter called ARCO, of the second part.

{ described in four (4) Indentures dated November 27,1964, October 20, 1969, January 26, 1970 and May 25, 1970 and, recorded in the office for the Recording of Deeda &c. , in and fpr the County .of Montgomery, aforesaid, in Deed Book .

! WHEREAS, said premiacs were acquired UNDER and SUBJECT to three (3) ease-I ments for a pipe line or lines granted to Keystone Pipe Line Company and one (1).

respectively; AND WHEREAS, said Keystone Pipe Line Company and Atlantic Pipe Line Company

recited premises and in order to conqply with a Nuclear Regulatory Commission request pertainin.; to the construction of the Generating Station, ELECTRIC requested that ARCO a6ree to modify said easements to prohibit the shipping of propane in and throu6h the pipe line or lines traversing said preminea; AND S

)GEREAS, the tnird abovementioned easement provides in Clt.use 4 thereof, "So said party of the second part agrees at its expense to take up and relocate j said pipe line within property of the said party of the firsii part at any time i or times when required to do so by the said party of the first part, etc." and l

ABCO requests that ELECTRIC agree to modify said easement to permit ARCO permanent status for'ite pipe line at this location; AND l

NOW, HEREFCEE, WITNESSNE in consideration of the mutual covenants herein and for other good and valuable consideration, and intending to be locally bound hereby, the parties hereto agree as follows:

1. ARCO agrees to prohibit the shipping of propane in. and through the 8

pipe line or lines traversing ELECTRIC'S Limerick Generating Station Site.

2. ELECTRIC agreca to tho deletion of Clauce 4 of tho third abovemontioned easement thereby eliminating the request of re' location by ARCO.

3 Except as herein provided, all other covenants and conditions of the four (4) abovementioned easements shall remain in full force and effect.
