) OL Motion to Reconsider re Contention 57-C-7 I inderstand the D.C. Circuit Court of Appeals has issued an opinion in case 8h-1091 (12 February 1985) reversing the Nuclear Regulatory Connission decision in Snn Onofre (on which this Board evidently relied in liniting the adnission of contention 57-C-7) that a list of hosnitals able to treat contaninated injured radiation victins in and energency response plan is sufficient.

The Court said, "For the reasons stated we reject as irrational the NRC's generic interpretation of section 50.h7(b)(12) with respect to members of the public exposed to dangerous levels of
