SERIAL 36156 This letter is being written pursuant to our discussions held with members of your Staff on August 24, 1984 in Glen Ellyn, IL concerning various licensing issues related to the suspension of work for the completion of the Midland Energy Center. The following lists these activities followed by a specific request:

1. Reference 1, Amendment I to the Conetruction Permits, directed Consumers Power Company to submit certain quality assurance information established by ALAB-106. It is requested that this requirement be deferred until such time, if ever, as the project is restarted.
2. Reference 2, approved the implementation of an independent design and construction verfication program. It is requested that Consumers Power Company be allowed to defer its commitment to implement this program until such time, if ever, as the project is restarted.
3. Reference 3 notified you of the Midland shutdown. It also indicated that it was our intention to maintain the Construction Permits. Requests for Construction Permit extensions will be forthcoming. As NRC Bulletins, Information Notices and Generic Letters are received, it is requested that any action required, not directly related to shutdown activities, be deferred until such time, if ever, as the project is zestarted.

A construction permit extension request has been filed (reference 4); however, it is our intention to not update those documents related to the operating license application. Therefore no amendments to the Final Safety Analysis Report, the Environmental Report or the Ceneral Information Volume will be submitted until such time, if ever, as the project is restarted. A Quality Assurance Plan addressing shutdown quality-related activities will be submitted for NRC approval. The Company would prefer that the NRC staff incur no additional expenses in connection with the Midland Plant unless and

.until completion activities are resumed. The Company will inform the NRC of any material change in the status of the Midland Project.

Your concurrence in these requests would be most appreciated.
