/ Is based upon documents issued by the NRC in mid February 1984. These documents indicated that sufficient information had been developed to warrant ASLB consideration of the TDI quality assurance and operating ability issues ratsad therein. The. secy-84-34 Policy Notice contained in the Feb 15. 19840 Ki 84-024 most clearly reveals the great signifi-cance which the NRC attributes to the TDI safety issues. Prior to the' issuance 1or' the Februarf documents, I considered the NRC review of TDI Issues to be in an information - gathering stage lacking the overall assessments upon which this contention is based.

f l (11) In the absence of other OL part.les contentions on this matter, other means of protecting petitioner's " interests on the TDI Issues did not exist.

(iii) The Midland OL record w!!! be- more: soundly developed if if the TDI safety issues are addressed. Intervenor hopes to proifuce a witness on these issues.
