Dear Dr. Slaughter:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated February 11, 2020 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML20049A037), which requests additional information for the fees assessed under §10 CFR 170.21 to Aerotest Operations, Inc. (Aerotest) within invoice LFB 20-1849 for
$24,047 dated January 15, 2020, for Docket No. 50-228.
In your letter, you state that Aerotest contacted the NRC by email on January 22, 2020, and February 4, 2020, for additional information requesting the breakdown of the associated costs and efforts of Mr. Geoffrey Wertz, Ms. Sara Reed, Mr. Michael Norris and Mr. John Nguyen.
However, the email address(es) listed within your letter that you state Aerotest used to contact the NRC are not valid email addresses. The correct email address for general questions related to invoices is fees.resource@nrc.gov. You may also contact (301) 415-7554 with invoice questions.
After coordination with the NRC staff, I confirm the staff time charges are valid. The work specified within the invoice is for activities related to the review of Aerotests possession-only license amendment request (LAR) submitted by letter dated March 21, 2019 (ADAMS Accession No. ML19084A051), as supplemented. The hours indicated for the NRC staff referenced in your letter reflect the actual effort by each NRC technical staff member in support of this review. The hours include in-office review of the LAR application, preparation of the regulatory audit plan, including the regulatory audit questions, and preparation of a draft of the NRC staffs safety evaluation. The hours for Mr. Wertz and Ms. Reed also include other activities related to the regulatory audit conducted on December 11, 2019 (see ADAMS Accession No. ML20017A278), including preparation for the regulatory audit, time spent at the Aerotest Radiography and Research Reactor (ARRR) facility, travel time to and from the ARRR facility, and documentation of the regulatory audit activities. The activities conducted by Mr.
Nguyen and Mr. Norris relate to review of Aerotests operator licensing and emergency planning, respectively, as they pertain to the LAR.
For information on how the NRCs hourly billing rate is determined for FY 2020 (including the invoice period referenced in your letter), please refer to the NRCs FY 2019 final fee rule (https://www.govinfo.gov/content/pkg/FR-2019-05-17/pdf/2019-10051.pdf). Additionally, for any requests for information related to NRC staff or contractor charges, an NRC Form 527, Request for Information Related to Fees-For-Service, should be submitted to initiate the review process.
