APPUCATION FOR AMENDMENT TO OPERATING UCENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the New York Power Authority, as holder of Facility Operating Ucense DPR 59, hereby applies for an Amendment to the James A. RtzPatrick plant Technical Specifications contained in Appendix Aof thislicense.

This application for an amendment to the James A. FitzPatrick Technical Specifications proposes changes to Specification 5.5.B, page 246 and Bases page 246a, regarding the spent fuel storage capacity. Specifically, the number of spent fuel assemblies that can be stored in the spent fuel pool (SFP) will be increased from 2,244 to 2,797. Also, the new amendment application date and references to the analysis report are added. These changes are the direct result from a proposed modification to add five storage rack modules to the SFP.

The FitzPatrick plant SFP was teracked following approval of Amendment 55, dated June 18,1981, with high density racks increasing storage capacity to 2,244 fuel assemblies.

Under the proposed expansion, five new rack modules containing 553 storage locations will be added increasing total storage capacity to 2,797. This increased storage capacity will extend the capability for a full core offload by six years to 1997. This effort is consistent with the objective of the Nuclear Waste Policy Act of 1982 which requires that licensees exhaust all means of storing spent fuel on site.

Continued operaticq of the FitzPatrick plant requires additional onsite SFP storage.

Additional storage capacity must be installed before the 1991 refueling outage if a full core offload is to be maintained. Therefore, the Authority requests NRC review and approval of this Amendment Application by December 31,1990.

The proposed changes to the Technical Specifications are presented in Attachment I to this Application for Amendment to the Operating Ucense. Attachment il provides the associated Safety Evaluation for increasing the spent fuel storage capacity. Lastly, Attachment Ill contains a Holtec Intemational Report titled, 'Ucensing Report for increased Spent Fuel Storage Capacity for the FltzPatrick Spent Fuel Pool," which provides detailed descriptions and analysis of the proposed SFP expansion.
