PILGRIM NUCLEAR POWER STATION - REQUEST FOR EXEMPTION FROM 10 CFR 50.82(a)(8)(i)(A) FOR HOLTEC DECOMMISSIONING INTERNATIONAL, LLC (EPID L-2018-LLE-0020)

Dear Mr. Sullivan:

The U.S. Nuclear Regulatory Commission (NRC) has approved the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR)

Section 50.82(a)(8)(i)(A) for Entergy Nuclear Generation Company (ENGC) (to be renamed Holtec Pilgrim, LLC) and Holtec Decommissioning International, LLC (HDI). This action is in response to your application dated November 16, 2018, which requested the exemption to allow Holtec Pilgrim, LLC and HDI to use funds from the decommissioning trust fund for spent fuel management and site restoration activities for Pilgrim Nuclear Power Station (Pilgrim).

This exemption was requested in relation to the November 16, 2018, request by Entergy Nuclear Operations, Inc. (ENOI), on behalf of itself, ENGC (to be known as Holtec Pilgrim, LLC), Holtec International (Holtec), and HDI for NRC approval of the direct transfer of Entergys operating authority to HDI and the indirect transfer of control of the Pilgrim Renewed Facility Operating License and the General License for the Pilgrim Independent Spent Fuel Storage Installation (ISFSI) to Holtec, as the licensed owner.
