ACCEPTANCE REVIEW OF LICENSE AMENDMENT REQUEST FOR SPECIAL NUCLEAR MATERIAL LICENSE SNM-928, CIMARRON ENVIRONMENTAL RESPONSE TRUST CIMARRON FACILITY

Dear Mr. Halliburton:

The U.S. Nuclear Regulatory Commission (NRC) staff received the Cimarron Environmental Response Trusts (CERT) November 2, 2018, request to amend special nuclear materials license SNM-928 for the CERT Cimarron site near Crescent, Oklahoma (Agency wide Documents Access Management System (ADAMS) Accession No. ML18323A197). In its amendment request, CERT requested approval of its Facility Decommissioning Plan - Rev1 (DP) for the Cimarron site. The NRC staff has completed its administrative review and has accepted the DP for detailed technical review. To expedite the detailed technical review, the staff has enclosed a list of supplemental information needed to conduct its review. Your prompt response will further expedite the review.

The NRC staff has prepared a schedule for review of this amendment request. The schedule shown below is based on several assumptions:

  • There is no hearing on the amendment request.
  • Timely resolution of any issues or concerns raised during consultations with other Federal, State, tribal, and local agencies, such as those required by Section 7 of the Endangered Species Act of 1973 and Section 106 of the National Historic Preservation Act of 1966.
  • The number and complexity of comments provided by the State of Oklahoma does not require more time and effort than anticipated for resolution.
  • No lapse in appropriations for the NRC or other cooperating or consulting agencies.
  • CERT provides timely and high-quality responses to the NRC staff requests for additional information (RAIs).
  • CERT remains grandfathered under the Site Decommissioning Management Plan criteria.
  • There are no major modifications to the amendment request.

The schedule for the NRC staff review is as follows:

Projected NRC Milestones Completion date Issue environmental review request for additional July 15, 2019 information Issue safety review request for additional July15, 2019 information Issue draft Environmental Assessment to OK April 3, 2020 Final Environmental Assessment Sept 11, 2020 Finalize Safety Evaluation Report Oct 16, 2020 Issue Amended License Oct 23, 2020 The NRC anticipates CERT will commit to provide the necessary information to the NRC in accordance with this schedule, which will allow the NRC staff to complete its safety and environmental reviews by September 11, 2020 and issue the amended license by October 23, 2020.
