GE HITACHI REQUEST TO CONTINUE THE LICENSING PERIOD FOR LICENSES DR-10 AND TR-1

Dear Mr. Murray:

By letter dated December 15, 2015 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML15349A045), GE Hitachi Nuclear Energy Americas, LLC. (GEH) requested to continue the licensing period for shutdown power reactor license DR-10, for the ESADA Vallecitos Experimental Steam Reactor (EVESR), and for the shutdown test and research reactor license TR-1, General Electric Test Reactor (GETR), at the Vallecitos Nuclear Center (VNC), which both carry an expiration date of January 16, 2016. This would match the license continuation granted to license DPR-1 for the shutdown power reactor Vallecitos Boiling Water Reactor (VBWR) by letter from the U.S. Nuclear Regulatory Commission (NRC) to the General Electric Company dated November 3, 1997 (ADAMS Legacy Accession No.

9711120128). The request also noted that license continuation for EVESR and GETR would be in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 50.51(b) that allows each license of a production or utilization facility that has permanently ceased operations to continue in effect beyond the expiration date until the Commission notifies the licensee in writing that the license is terminated. The NRC agrees that this regulation applies to EVESR and GETR and that a license renewal is not needed for those facilities.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system, ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
