Dear Mr. Fettus:

I am contacting you to provide a status update on the petitions for rulemakings that you submitted to the U.S. Nuclear Regulatory Commission (NRC), dated July 21, 2018 and July 26, 2018, on behalf of the National Resources Defense Council, Inc. The NRC docketed your letters as petition for rulemaking PRM-50-97, PRM-50-98, and PRM-50-99, respectively.

  • In PRM-50-97, you requested that the NRC institute a rulemaking proceeding applicable to nuclear facilities licensed under 10 CFR Parts 50 and 52 and other applicable regulations to require emergency preparedness (EP) enhancements for prolonged station blackouts (SBO) in the areas of (1) communications ability, (2)

Emergency Response Data System (ERDS) capability, (3) training and exercises, and (4) equipment and facilities.

  • In PRM-50-98, you requested that the NRC institute a rulemaking proceeding applicable to nuclear facilities licensed under 10 CFR Parts 50, 52 and other applicable regulations to require EP enhancements for multiunit events in the areas of (1) personnel and staffing, (2) dose assessment capability, (3) training and exercises, and (4) equipment and facilities.
  • In PRM-50-99, you requested that the NRC institute a rulemaking proceeding applicable to nuclear facilities licensed under 10 CFR Parts 50, 52, 100 and other applicable regulations to require licensees to confirm seismic hazards and flooding hazards every 10 years and address any new and significant information. Further, you requested that if necessary, update the design basis for structures, systems, and components (SSCs) important to safety to protect against the updated hazards.

The notice of receipt for these petitions was published in the Federal Register on September 20, 2011 (76 FR 58165). The NRC continues to evaluate the issues raised by the PRMs. The status of your PRMs can be found at the NRC Rules and Petition page at https://www.nrc.gov/reading-rm/doc-collections/rulemaking-ruleforum/active/PetitionIndex.html.
