SUBJECT: U.S. NUCLEAR REGULATORY COMMISSION RESPONSE TO DISPUTED

NON-CITED VIOLATION 05000334 AND 05000412/2018403-02

Dear Mr. Bologna:

I am writing to acknowledge receipt of First Energy Nuclear Operating Companys (FENOCs)

letter dated May 24, 2018, in response to the U.S. Nuclear Regulatory Commission (NRC)

Inspection Report 05000334 and 0500412/2018403 issued on April 27, 2018 (cover letter

ML18117A265, cover letter with non-public report ML18116A504)1 and errata issued on

May 9, 2018 (non-public report ML18129A070).

The letter (cover letter ML18149A116) contested a Beaver Valley Power Station (BVPS) Green

non-cited violation (NCV 05000334 and 0500412/2018403-02). The letter stated that FENOC

correctly evaluated and implemented appropriate cyber controls. The NRC intends to review

FENOCs response and provide you a letter documenting the basis for any decision relative to

the disputed NCV within approximately 90 days.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRCs

Rules of Practice, a copy of this letter and your response (if any) will be available electronically

for public inspection in the NRCs Public Document Room or from the Publicly Available

Records component of the NRCs Agencywide Documents Access and Management System

(ADAMS). ADAMS is accessible from the NRCs website at http://www.nrc.gov/reading-

rm/adams.html (the Public Electronic Reading Room).
